Hi Guys,

I purchased an item on ebay which when delivered was ⊗⊗⊗⊗. I've contacted the seller a few times and had no joy. I paid via paypal.

First time I've had this happen as a buyer. What the best way of getting my money back?

If the the seller does not cooperate then a ebay/paypal dispute.

Same way buyers handle us sellers.

I've tried twice mate. They won't reply.

As a seller I know what it's like when someone opens a claim without contacting you first. The thing is the item is ⊗⊗⊗⊗ and the seller won't reply. They had excellent feedback as well.

Looks like I'm going to have to open a claim.

Yep, claim is the next step here. If they still do not repsond get eBay involed and they will be able to get it solved for you

With the seller not responding it has GUILTY written all over it unless you only wrote to him today? As most people are not logged in 24/7.

You bought item from ebay and paid by PP?
Or you bought and paid only using PayPal?
Money was send as services and goods? or family,friends?

Try opening dispute if seller doesnt reply and provide pictures to PayPal aswell, they have a section once dispute is open, you can upload anything to win this case.

eBays a funny place.

People love to be phakes at the rock bottom prices, until something goes wrong with it, then they dont like phakes.

First, contact the seller via PM. If seller does not answer in 48 hours, open a dispute and you will get your money back.

Also, I dont like the whole load of advice as 'open' a case, as we all know the defect policy is made to break people, so why would you do that?

Was the item actually advertised as a certain brand?

What was the price? if its 1/4 less than the retail cost or something, you knew you where buying a phake, being a member on here, means it ain't your first rodeo and you know full well how to get your money back!

How long has the seller not responded for?

I would allow one more message stating that you will open a case if no reply is made. This is a fair warning before the defect system gets involved.

I suggested to contact the seller first. If he ignores PMs or refuses to solve the issue in any way that will satisfy buyer, then the case should be opened. I am strictly against opening cases if the seller tries to do his best to solve the issue.

I do agree that opening a case should always be the very last resort only after you have given the sellers a few days to respond. Sometimes the only thing left is a case though

The item was described as authentic.

It was a a medium price the item is worth.

Yes, it was advertised as a certain brand.

I have messaged them 3 times over 4 days and no response.

The way I look at it is, if you knowingly sell ⊗⊗⊗⊗, you deserve everything that gets thrown at you. Even more so if you won't deal with customers concerns. I would of thought they would of wanted to resolve if they are knowingly selling ⊗⊗⊗⊗ to keep ebay out of it.

It's sellers like this that put buyers off of buying from legit sellers on ebay.

couldn't agree more. It seems the seller is the only one to blame all the time.
Their are just as many buyers wanted knock off items and rock bottom prices but as soon as they get them, they try their buyer protection nonsense and threaten with ebay resolution.

They know too damn well what they are buying at that price most likely is not the real deal, so personally I don't sympathise with them.

Sellers get screwed trying to please buyers with cheaper prices and still get burnt, however its the odd one or two that have the problem.
Majority accept what they got and even leave you with top feedback.

What about when you purchase something for what it's worth and you're supplied a ⊗⊗⊗⊗?

At the end of the day if something is listed as authentic, then it should be.

Selling ⊗⊗⊗⊗ isn't a sustainable way of running a business. It won't last.

If its sold out and rare then one wouldnt expect to pay less than retail on ebay for a genuine article.

Anyways, I think possibly the ebay community forums might be the best place for your question, the buying forum love destroying sellers, youll get advice on how to cause death and destruction on a sellers account within minutes!

I don't want "death and destruction" just a refund for something that wasn't as advertised. If you purchased something from Rolex in the sale, you'd still expect it to be Rolex, not a cheap ⊗⊗⊗⊗ because it was in the sale.

I asked for advice because I sell thousands of items on ebay and never have a problem with claims, because I don't sell ⊗⊗⊗⊗, I describe my items accurately, and I respond to buyers in a timely manner.

All I wanted was some communication from the seller and a refund for something that wasn't as described. I think that's quiet normal. I could of left bad feedback, contacted trading standards etc. I was reasonable.

Give them a few days to respond. Send a couple of messages 48 hours apart.

If not response, open an item not as described case. The seller will pay for the return, print the returns label off, attach tracking number to the case. Your money will be refunded.

Sellers of Phakes ruin ebay for the genuine sellers. They deserve what they get.

I agree, but you sell accounts, and many of them are to people selling ⊗⊗⊗⊗, dont fuel the fire if you don't like burning :)

Yes we may sell accounts but it does not mean any of us allow the sale of foofoo items, this logic is not logic at all.

Wired, the point of the forum is to help genuine ebayers get back to selling. Alot of people have been screwed by ebay, including when they introduced the defect system and back dated the defects a year without warning.

This forum is designed to help those who have been wronged.

I personally try and help GENUINE people to start again. The people that obviously want to scam or sell phakes i do not help. I do not sell to.

That is not the point of the forum or the marketplace here. Of course some will fall through the gaps or play the system to their advantage, that can't be helped.

You have been posting alot lately without knowing any of the facts. Your posts have become more and more negative. You seem to have developed a know it all attitude. You shouldnt make flippant comments without knowing the facts.

Im not entirely sure on your point, youve made reference to things that I had not even spoke about.

You fuel people selling phakes by selling accounts, thats a fact, and thats all I said. You cant and dont know who is going to sell crap or not.

Dont provide the fuel, the fires wont light up as much. Simple as that really. Dont quote about how phakers are ruining ebay when you sell accounts to people who many of them will do. Contradiction of your own phrase in essence.

I dont know about that wired.
That is like saying McDonalds should not promote healthy eating because they sell unhealthy food or that nobody should have a firearm because a few people miss use them or that nobody can have a drivers license because some people drive drunk.

If it were me I would just send them a message saying please can you get back to me as my next message will be to ebay to ask them to deal with this, even though I do not wish to do this as i understand how damaging it can be to a sellers account.

Then just click report a problem a couple of days later and let ebay deal with it.

As to the ⊗⊗⊗⊗ argument, it has never really bothered me that much that people make a living out of selling ⊗⊗⊗⊗, even though I have never went down that road I know there is a market for it where people will buy a ⊗⊗⊗⊗, as the real thing is just too expensive and some ⊗⊗⊗⊗ these days are so close to the real thing that they have had to have been made in the same factory.
