Well, UK law has an element of 'precendency', for the interests of consistency, so finding other cases where the money was force released would be an idea, plus the evidence that most seller money is released at 180, so why not you. The other side would need to say why they would not do so, etc etc...

I think going legal would need to be after 180 non-release, before that, you probably do not have a leg to stand on re your question on superceding etc.

You cannot take legal advice on the forum, so if the amount warrants it, you should try and find a specialist in these cases.

My hunch is if a case comes up on paypals desk, they would rather settle/release. We do not hear of too many completed cases on the forum.

On the amazon threads recently, I think in USA, a forumer had a successful similar case/settlement (according to them), and registration details were stealth.

btw, I do sympathise with your situation, I just thought on initial posts, you were going off at a tangent and not focusing on what is actually realistically possible to do successfully...

However, a suit can be filed not only in the county where the defendant is located, but also at a place where a service was performed, or was supposed to be performed. PayPal stress that they are not a bank, but an agent that delivers money from a sender to a recipient. If you have ever made a withdrawal from your PayPal account, a service chain has been established that reaches to the bank where you have the account to which you withdraw money from your PayPal account.

As a service has been performed at the county where you have your bank account, you can take PayPal to a Small Claims Court in the county where you reside, or, at least, where you have your bank account. This gives you a substantial advantage. If PayPal as defendant want to contest your case, they will have to send somebody.
