Seriously, I hate people. Much prefer cats.

Back in May, this dude bought some stuff from me, totalling nearly £400. On arrival, he said he wasn't happy with the condition of the items - they were dirty, some were broken and no accessories were included.

I made no secret of any of the above while describing them. My descriptions were 100% accurate - he just didn't read them properly.

He decides to demand a partial refund of £75 from me in exchange for him keeping the items (as he felt that a £75 refund would end up being a 'fairer overall price for everything' :violin:. Hey buddy, don't pay so damn much if you don't think what you're paying is a fair price!)

Anyway, I partially refund him the £75. End of story. I hear nothing.....until tonight when he opens a PayPal dispute which he IMMEDIATELY escalates to a claim for Item Not Received. Now PayPal are obviously holding the full £400 from my account and if I can't convince them of my & the buyer's previous agreement, he's going to get all that money back.

Luckily, all the messages about our agreement are stored on eBay. You can even see the partial refund of £75 from the PayPal transaction.

I can't call PayPal until the morning at the earliest. What are my chances of wining this? :hail:

Funny how you give him back £75 and he still opens a case and escalates it to a claim.
Sounds like a real winner.

Do you have the convo of him demanding a partial refund in exchange for him keeping the item? Unfortunately with the case escalated to a claim, it will be up to PP to decide. You should give your side of the story tho, contact PP and tell them what happened.

Oh yeah but get this (and I don't know if the buyer had conning me 6 months later in mind when he did this) - but after he sent the payment, I told him that I'll be sending it with either Parcelforce or UPS. He instead tells me that he'll be organizing the courier from his end with Hermes and he'll email me the shipping label.

I kindly asked him to leave it to me as the courier I would choose would be more secure & certainly faster than Hermes. But he absolutely insisted and decides to tell me he's already paid for the label!

So I print off the label and wait for Hermes to collect. Unfortunately, that was a private email not through eBay so I no longer have that.

I do still have the conversations of our agreement in my eBay messages. I guess I'm going to have to screenshot these so PayPal can see them.

Is he able to ask PayPal to make a final decision at any point? Or have I actually got a set number of days before the decision making begins?

Something smells really rotten with this buyer, dogdy at best esp. considering he was pushing you to ship via Hermes.

Your best defence is to contact PayPal with your evidence and hope they will take that into consideration when deciding this claim.

Why is that private email is not available?

Can you not retrieve it from a back-up?

For the future, keep everything in a folder for any customer being an ahole.

I can give you a script to write if nothing is truly available

The label would have gone to a Mail.com account and once it's been permanently deleted, apparently it's gone forever.

I normally would keep a record of things until the transaction has been completed and both sides are happy. But I wasn't thinking 6 months down the line that he'd pull this!

Buyer was pulling a scam from the start.

When they organise there own courier, they are in control of the delivery. To win a item not received, you need a tracking number. Im assuming the buyer never gave you the tracking number?

Accepting paypal and allowing buyers to send their own courier is a big no no.

I was going to say you had a fair chance of winning, until I read the courier thing.

Can you contact the courier, as since you are the collection address, maybe they will give you the tracking from their records? worth a try.

You mentioned 6 months ago. Is it over or under 6 months as that could be relevant, even chargebacks via card often have that cut-off point.

The lovely lady on the other end of the phone heard my side of the story and said it all looks a bit fishy. She said PayPal's questions about the legitimacy of the claim would be:

1. Why wait so long before opening a claim if it's an Item Not Received (it's been 6 months)?

2. What was the partial refund of £75 for?

I told her I still had eBay messages but she didn't need to see them.

He can appeal the decision but she's added some notes to the case explaining that he's basically trying to chance his arm and so she thinks it's unlikely it'll get re-opened.

Thank God. They are helpful once in a while!

I did find a private email in my Mail.com account from him but with a different email address to the one he paid with. So I searched and found his selling account - on which he's making thousands and telling buyers that he doesn't give partial refunds!!!

I felt like messaging him, just saying 'nice try'. But my sister said 'don't poke the bear!' :lol:
