Default trade mark violation?

i had 2 buy-it-now listings taken down by ebay at the request of the manufacturer because they claim i am selling counterfeit items.
i took home taken pictures of the actual real item... not stock photos

i priced the listing 15-20% below MAP so i can under cut the other sellers whos also selling the same items, so i can flip the items quick (low margin, high volume sales tactic)

is the manufacturer just policing the bay for people selling it too cheaply and automatically deeming it to be counterfeit?

i am an authorized dealer (brick n mortar), but locally i must sell @ MAP, but i am trying to privately flip inventory online selling below MAP

Were you taken down by the Vero OR Ebay? A competitor(s) might have reported you and
It was enough for them to take you down.

the ebay message i received was a VeRO claim from the product manufacturer...
i have all positive feedback selling (100+)their particular brand of products on my seller profile, and they still thought i sold counterfeits

now, my policy violation is medium and they say that could affect my power seller/top-rated seller status

You have violated your agreement with the manufacturer by selling for less than their MAP.

Unfortunately, there is no way to file a counternotice on a trademark violation claim as their is with a copyright violation claim.

If the manufacturer finds out who you are, they could refuse to sell to you for your B&M store, and probably sue you for damages as well.

i found the one way to go around it is to auction the items (but obv that limits how many you can sell because the audience for the product isnt huge to prevent market saturation..

No you are the one making the BS.

You are breaking the terms of your dealership.

Go read the fine print B4 blaming other parties.

OP has a myriad of ridiculous issues going on with multiple market places. Sounds to me like they are doing a sh!t ton of things they know they shouldn't be doing and they just got caught.

It was an ignorant move to build your business around such nonsense.
