If I were to make my own design on something and I made an action figure character on this thing I was designing and wanted to sell it on ebay afterwards, would that be considered copyright infringement?

yea if it looks like iron man I wouldn't risk it. Making your own iron man costume or beanie or something as a one off you will be OK but if your trying to manufacture a whole load of these under your own type of brand without the express permission or license then your asking for trouble really.
