However, without getting to much into details, the rights owner will have to prove that a huge damage was made to his brand if they really want to go there. In other words, if they want to sue you for 1 million, they better have some proofs that this was about what you made by using their name/logo/trademark. In most cases getting to court against small sellers wouldn't be worth for them, unless they want to prove a point or scare others. The first step would probably be a warning letter from their lawyers,
and maybe a signature will be required that you won't use their brand
name in the future.
I don't have experience in court or anything, I just made a lot of reading about the subject.
There are still many, too many sellers on ebay that sell counterfeit only. But they are mostly from outside of the USA. |
