You don't need an EIN to start with, but you WILL need one after you sell your first 50 items. That is when they will ask you for a tax-id number. The GOOD NEWS is, by the time you hit 50 sales, you pretty much know that the account will last, assuming you abide by Amazon's rules and give good customer service.
Whether to start an S-Corp or an LLC depends on your personal situation. Most people go with an LLC because the paperwork and hassles are much less than with an S-Corp. But I would check with a tax professional just to make sure you are choosing the right one. They do cost a couple hundred dollars, but they can save you THOUSANDS in taxes, so I always thought of it as worthwhile.
Also, DO NOT ABANDON YOUR ACCOUNT! APPEAL! You have NOTHING TO LOSE BY TRYING! If they refuse, then, oh well, at least you tried. They will want you to write a business plan to show how you are going to deal with whatever issues, but it does not have to be very involved or complicated. Just come up with fixes to the issues and put them on paper. Unless you were suspended because they suspected you were selling counterfeits, or were extremely rude to a customer, you should be able to get back on easily enough.
