Default Email from Amazon regarding suspension

Hello. As some of you may already know my seller account was suspended for suspected IP Infringements for selling Wireless bluetooth EarPods around a month ago. I have sent over a dozen appeals and basically gotten the standard bot responses until I received this today. I'm asking for anyone's help/advice on how to proceed from here as these products were not Apple products and it's probably important to note they did not claim to be or have any Apple logos.


EMAIL FROM AMAZON:


"Hello from Amazon Selling Partner Support,

From your mail I understand that you are concerned about the ASINs which you have mentioned.

We have contacted our concerned team with regard to this issue and now we received a response from them that we removed some of your listings because you may have improperly used Design Patents of "APPLE" you do not have the right to use on the product detail pages for your listings.

If you believe the reported listing does not infringe the "APPLE'S" patent and the removal was made in error, please provide supporting documentation (e.g., letter of authorization, licensing agreement).

Once you provide us the required information then we will be able to take necessary actions.

Awaiting your response.

Most of you probably know Amazon has a deal with companies like Apple, Nike, etc in which they remove listings and suspend accounts and issue IP infringement warnings on as many listings as possible that could be considered competition against aforementioned companies. Any advice/help on how to proceed is greatly appreciated.

Hey Tin,

Thanks for the honest advice. I retained the services of Josh who helps sellers reinstate accounts on here and we thought this was a step in right direction? (considering they had never replied with much more than a standard bot type response before).

The wireless EarPods I sold didn't even look like Apple AirPods, they were a different design and did not feature anything remotely close to an Apple logo or try to make it seem like they were, AirPods weren't even in the name of the product, they were called TWS IS7 wireless bluetooth EarPods. I can see if they claimed they were an authentic Apple product or had a ⊗⊗⊗⊗ Apple logo but they didn't so that's not a counterfeit unless I'm missing something here?

Hey Tin,

That's a bummer. I already spent the money for the reinstatement services.

Unfortunately for my account what you say seems to be true regarding Amazon's deals set up with companies such as Apple. Where I get confused is why would they keep allowing me to resubmit appeals/POA's (14 times now through seller central and there is still a button for "submit additional information" and keep replying to my emails and not just ignore me or ban me?

Tin,

I'm not saying you are not correct, just asking why they would (at least in my opinion) keep leading me to believe my account can be reinstated by replying to all of my appeals (14 times now in a month) and leaving the option in my seller account to submit additional information to my appeal/POA?

Yes they are still responding, in fact the last two responses I received are the only ones that seem to have come from an actual person and not a bot response. They also sent me an email without contacting them encouraging me to submit the information to them so my account could be reinstated. I double checked, it's been 15 times now...definitely not what I expected since the majority of sources online claim you only get two or three chances to appeal your suspension.

AMZN does not believe anyone can keep trying 14 times,cant you take NO as No.?
forget selling on AMZN,sell them on Ebay or other sites

Thank you, that was a very polite and useful reply. I guess you missed the part where I stated I only listed these when I first started selling almost 6 months ago as well as the fact that Amazon emailed me (without me contacting them) to reactivate my account?

P.S.- It's 15 times, not 14.
