Barry, the link you displayed has nothing to do with the UK small courts claims, its a completely different Euro Court system. Have you read the pdf within the link, max claim 2000 euro and YOU HAVE TO ATTEND a hearing if the Defendant files a Defence and amazon will surely do as its filed in Luxembourg.

I can feel for the OP. It sucks to think you got ripped off by Amazon. But I agree with the others, it is going to cost you some bucks even if you do it yourself and there is NO guarantee that Amazon will end up paying you.

If this battle has been going on for 5 years, maybe it is not just about the money, but still.

If it were me, I would have just created a bunch of new accounts. Sales = Money. Court battles RARELY = money.

The small claims process within the EU is the same as the small claims court in the UK, it's just for cases that cross borders. Maybe calling it a small claims court was not specific enough but it's still viewed as the same process for reclaiming damages. The small claims process.

THERE IS NO NEED TO TURN UP. I'm Not sure why you capitalised that but it's simply not true.

An oral hearing can be requested but This does not mean you have to turn up. Something like Skype would be perfectly acceptable.

But there is very little if any chance oral hearing would be requested in This situation anyway because

1- Amazon would never turn turn up as they would have to send a lawyer which would be charged at a days work or more with prep.
2- but hypothetically if they did and they for some reason requested An oral hearing it would not be granted. The facts would be black and white and the whole process is to reduce time and costs. Every decision the court makes hasty abide by that philosophy so a request for an oral,hearing would be turned down.

Anyway. If you want to argue that fair enough but I really am leaving it at that.

Please read from page 41 on the pdf thats within your link.
Amazon have in house Lawyers so the cost is minimal (I know this from experience)
Barry, I hate to argue but why are the facts black and white, we don't the reason why his account was deleted, maybe ⊗⊗⊗⊗, fraud which are all covered in amazon terms.
So your reasoning we can all make a claim against amazon, make up evidence, amazon will not be able to contest it and we win.
Have you ever heard of the saying "setting Judgement aside" Skype is not permitted in any Court room. There is a facility for telephone conference but that has be agreed by all parties and has to used through the secure Court communication system. Please Google the answers are there.

Not only can Skype 100% be used. It has been. It's also been used in high court cases in the UK and countries all over the world. so I'm not sure what you are googling but it's not right and a Simple 2 second search will show you that???

But that's not even relevant. The point was you don't have to be there as you said you do. I was trying to help OP not win another petty argument.

The factS are black and white because Amazon have to prove they had good reason to keep the money. Either they prove it or they don't. The judge wouldn't request a witness.

If you want me to clarify anything else or to continue this please send me PM and let's stop both of us derailing another thread.

It has been a long standing instruction on this forum that advice not be given on legal nor tax issues.

Continuing to post in open as you are asserts knowledge that is one-sided.

It appears you have missed the potential of an account being stealth yet you go suggesting remedial action at law to obtain funds. There are repercussions of that.

My only advice is you don't need legal advice to go to a small claims court and you don't need to be there in person if it is within the EU.

I'm not sure what the problem about 1 sided knowledge though? These are facts so the knowledge can only be one sided.

In the EU/ UK this is well known information about small claims courts. Not so much about the EU oral hearing but that hardly ever happens anway.

Barry you may be getting confused between the Magistrates Court and Crown Court where I believe SkyPe can be used, however in the County Courts across the UK,Skype cannot be used only telephone conferencing and limited use of Video conferencing, this also applies to the small claims in Europe.

How doesn't that link say Skype is not used

Becuase the actual body that oversees these cases says it can be.

You do realise limited use of video conferencing I means Skype don't you?

Thanks for everyone's input - I understand you may see this as wasting time going to court but I will try send Amazon an email then submit the small claim.

I already have the Amazon Stealth Guide when I first got banned. I'm not looking to sell on Amazon again. I prefer eBay but just got banned on that as well!!!

Alan, seriously, (just ignore the banter) look at why you are getting banned or deleted. You must be doing something wrong. Send the email, several times this costs you nothing. Anything else use your energy on sales, not history.

I was banned for selling to fast - I never had enough feedback to support my sales.

I was subject to the Amazon A - Z crap then never let back on and money failed to turn up.

I made that amount within a week of sales.
