Have you refunded the buyer?
My opinion is don't, as if you do you are accepting liability.
Have you contacted the buyer since the phones return.
Was the phone sent back requiring a signature?
From amazon's point of view they will take the buyers side as you cannot prove what you actually sent in the first place. I would say you never received the package back or the box was empty. This this will then put the onus back onto the buyer to show the goods were actually returned.
Also this buyer could have done this scam before and amazon will have a record of his purchases.
