Very good point... If you really want to get your item noticed the name has to be in the description anyways.
Be aware that the item can be taken down if the image is blurry and it does count as a V ERO violation. I've had items taken down and ebay pinned the reason on my picture being blurry. Either way you are at risk when selling a branded item. I would just take a clear picture so the seller can get an accurate view of what they are purchasing and have stealth accounts to back you up if something happens.
My bad advice is - just say ef it and list it using the v ero name and hope for the best. You are playing with fire anyway, why not crank the heat right up?
You are essentially playing some high stakes roulette...let's just hope e bay and the trade name/rights holder aren't both pointing the gun at you when they pull the trigger!
