Whole seller cant refund when?

I have been using this whole seller a good while, never had any kind of issues,
Now we have ordered 4 separate orders coming from China,
The 2nd order will be in my hands today i ordered 12-3-2010,
It some how jumped the order from 11-28-2010,
Now i found my 12-5-2010 and 12-7-2010 will be leaving to USA soon,
All from the same supplier,
The last updated on ems is showing my 11-28-2010 order is
still Despatch from Sorting Center,
That is in GUANGZHOU last updated on 12-1-2010,
Does that mean from China or has it already left and would it be in another foreign country before getting to the USA?
They told me this, when i asked what if it was lost or something,
for our regulation is that if the goods met with troubles in China,we will resend the full parcel or refund full payment,while if the parcels meet with problems out of china,we won't have the obligation to refund
Will alibaba be easy to dispute the charge if i never get the item?
I am confused and need some help,
Do all whole seller have this policy or do i need to find a new one?
