Copyright Infringement Notice From User

I sell ebooks that I write myself on ebay. I also sell video game strategy guides that I write myself not the free ones you can download online. Everything was going good until today when an ebay member sent me this email.

My company is informed with regards to the copyright violation of our products.

UNDER OUR COMPANY'S COPYRIGHT INFRINGEMENT

BradyGAMES prohibits the posting of any information or materials that violates or infringes the copyrights of any person or entity. If you believe that your work has been copied and made available on this site in a manner that would constitute copyright infringement, please provide the following information in writing to our designated DMCA Copyright Agent:

1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
2.a description of the copyrighted work or other intellectual property that you claim has been infringed;
3.a description of where the material that you claim is infringing is located on the site

If your listings are not closed, please be prepared to face legal charges. This is a first and final warning to you.

Now, here is the thing. I believe that this is from another competitor not from BradyGames. Why is that you may ask? Well, the user who sent me this name is BradyGAMES2009 and the account was created OCT. 31 yesterday and Bradygames is located in New York not Indiana as this persons location is. What I want to know is do you guys think that this is legit or if its just a competitor trying to scare me. I mean if it was the real deal wouldnt they contact ebay get my info and send me an official letter or call me?

I am no expert, but I have seen this same questions by a forumer a few weeks ago, do a search there were alot of answers.

As a copyrighted author (which I am), I can tell you from experiance that such a letter would NOT come through the mail but rather from an attorney via snail mail who would have obtained your information from Ebay. And, you'd probably get the Ebay letter of complaint FIRST.

My suggestion.....buy a block of numbers from the Library of Congress (I think the maximum is 10) to add to your listings stating YOUR work is copyrighted which takes Ebay out of the "copyright wars". It's not cheap to buy Library of Congress numbers for writers, but well worth it as NOTHING is not stolen any longer...including how you put two words together.

Usually they just report you to Ebay first if they are the Rights Owner .
