cant you ask him for a statement from the post man, he says he saw the package had been tampered with, a postman will tell the truth, i had something similar a while back someone returned a very expensive item to me when i got the package it felt light so i asked the postman to wait while i opened it, it was empty but i had a witness to the fact and the buyer dropped her claim as soon as i informed her of this, so id ask for proof the postman was there, you'll know either way then

thank you!just left a msg at the case to ask him to get statement from postman,i will see what he will react on this. from what i see, he's never wanted to contact royal mail for this issue but threatened me to resend.

Did you drop ship these?

If you did, why did you not go back to the distributor?

I'm aksing because your flag is CANADA but you say China post sent the items.

this is a parcel to UK? the royal mail will not give a statement and ebay will not require buyer to get one! these cases are really automated and if looked at manually strict rules are used. tracking is key, or if the person says received, then you are ok generally, however if it goes to manual review, they wont be taking statements but the weight issue is important, however buyer is not saying you did not send the right quantity, he is saying it broke or slipped out, that now is down to ebay to decide on a manual review, they will either say you sent it and it got received, end of story or they will refund customer, they will not require you to send another package.

Why not hold the advice until the OP says wether this was drop-shipped or not dropped shipped.

my advice has differed as new info keep coming thru! agreed, I was wondering that, canada flag and china postage, ebay doesnt like dropshippers, you may unecessarily get their attention.....

this is a kind of dropshipping, i have a friend in china who is supplier and he is sending the packages for me. i personally have seen the boxers as he mailed me couple of samples. i've just asked him couple of days ago to take pictures of every outgoing packages before sending them out just in case something happens.

since op said i may get unecessary attention from ebay, so i think i won't call ebay. i post all the info at ebay including the weight fact to let them do a review on this.

besides, in the latest msg from the buyer, he said "I noticed on the package it states that it maybe open by customs so maybe it happened there but there is no indication of any one trying to reseal it." this guy just has no common sense, if the customs want to open it to check, they will for sure reseal it then pass it to the post office.
so i think he is taking advantage of this.

buyer escalated the case to ebay, i have 72hrs to issue refund if i want. should i refund him to end this or wait ebay to review it?

You cannot win this - it's all about damage limitation - don't risk your account for $40. It will cost you a lot more than that if you do.

As part of your future business plan, pick a figure where you give automatic refunds, no questions asked, no you said, he said. Make it so that when you get a complaint, you take a deep breath, give the refund and move on.

You can't be spending time worrying as that is x4 pairs of boxers not sold ;)

either refund or send again after his first message depends on the value of the item
