You might win. Its a 50/50. Since its not a physical item paypal doesn't like those items. If you paid via debit or credit card through paypal I suggest you open a claim through debit/credit card and try to see if you win that way. If you paid through paypal funds then you might win or not 50/50.
The last time I disputed a virtual item when paying with Paypal for an eBay item, I lost.
Seller wrote "Delivered Virtually" instead of a tracking number.

No, they will not care in the slightest. I doubt he has any money left in the account, or any real Cc or bank the can refund you with, so there next option is to stick it to you. If they deny you, file a chargeback with your credit card company.
im sorry to say you may be out of luck. Just chalk it up to a very expensive lesson, and dont buy virtual/digital goods online. Just give that person a very negative feedback and move on. Like the above poster stated, you may be able to do a chargeback, or file an item not as described.

Contact paypal by phone then and talk to them. Tell them what your problem is and see what they say. they are a valuable way to get good info sometimes in cases like this. Good luck.
