Default chances of winning this case

guy purchases an item from me (200+ Value) i ship ups few days later i check and it says delivered left on porch 2 days after the guy says he was on vacation and never received anything so basically he "claims" stole the package off his porch and he thinks somehow this is my fault i requested the package be signed for did everything 100% right on my end so i filed a claim with ups now the guy emails me and says none of this is his problem and hes going to open a claim with his bank and with paypal will i win this case?

i did use signature but the ups driver left it anyway then he comes back in town the next day and says he cant find it this happened last thursday btw ive been dealing with him back and forth for a week

Sorry but his story smells funky. If he ordered the item while on vacation he could of let the OP know of this or he probably figured UPS would hold his package for pickup. When shipping expensive items you really gotta go with signature confirmation.

thats exactly what i told him i asked why didnt he let me know then i could have requested it be held at ups he never replied to that just went on to say hes going to leave negative feedback and is going to file a claim with his bank and paypal

make sure you take a photo or screen cap in paypal that says seller protection and you should be fine. They might side with the buyer, but with your proof of sig-conformation and tracking, they will have to eat the fees.

Your buyer is definitely a scammer. Most scammers are constantly weighing the risk and benefits of scamming. One strategy, in this situation, may be to make the cost of scamming you too high.

He is banking that he will keep your product, get his money back from paypal, and you will go quietly into the night. His worst fear is that you get the authorities involved, he gets convicted of theft by deception, mail fraud, wire fraud, and he ends up doing 10 years in the federal pen for an item under $300. This is extremely unlikely because the authorities have bigger fish to fry. But every now and then you see a story in news that some small time internet scammer was snatched up by the FBI.

My suggestion is to make him believe he has a larger chance then he thinks of being the next scammer to be outed. Send him a veiled threat email that to an idiot may look like you are sympathizing with him. Tell him something like you are going to refund him but first you have to get the authorities involved (maybe for insurance reasons) to catch the thief that took the package off his porch. Mention that you are gonna forward the police his emails to help them with their investigation and make light of the fact that alot of people in all neighborhoods these days have cameras pointed on their streets.

This has proved to be an effective method for me in the past for calling scammers bluff.

Im guessing along the lines of a scam as well, I am currently dealing with a scammer and its pretty much the same scenario. It tends to occur more around this time of the year so be prepared. I do believe for items valued at $250 and above signature confirmation is required to be covered under paypal seller protection along with some other criteria but it seems you probably meet all of them. I had a guy even try to do a charge-back and paypal still sided with me so you still have a very good fighting chance. I play these guys out in a similar fashion as Futuremogul888 mentioned.

I have lost an exact case like yours... Sounds identical... I was 100% sure that I would win the case... I lost fairly quick after review... You are never safe when it comes to ebay/paypal reviews. My item was under $250 and didnt even require signature. The tracking showed delivered. Everything was in my favor and I lost the case...

Maybe you can minimize the loss by reshipping the product instead of taking a total loss. Had I known I had a chance of losing my case I would have offered. Then I also got a negative feedback. By offering to reship you might also save yourself bad feedback. Its worth looking at the big picture...

Things don't work like that. I doubt the driver would just leave it. You need to speak to ups if this is true

Logic only applies to Vulcans

UPS and Fedex drivers do just leave packages at the front door. They knock once and they bolt, esp. under this time of the year.

Last year around the date today, I had a very expensive laptop, $2k, just dropped off at my apartments front door. The UPS driver didnt bother to leave it at the Manager's office. I was lucky nobody stole it since it was there only 35 minutes, but still, it only takes 5 sec.

These drivers dont care, they just drop and run.

If he went straight to opening a claim with PayPal, that just alludes to the fact that that he knows what he's doing, and is attempting to abuse the power of PayPal's buyer protection policy.

Tell PayPal to make the buyer prove he was on vacation lol.

If you lose the claim, then perhaps try your luck by opening an insurance claim with UPS?

just keep it simple. if you requested signature confirmation, ask for a signature. you can then send this into paypal. if they don't have a signature then complain to UPS. just play it step by step and make sure you got the service you requested. i know people on here are saying that they leave packages on doorsteps but i personally have never had that and have had a ton of ups deliveries. if i am not home, i get a notice for redelivery.

this is for ups service in uk I am talking about;

ups do leave it all the time actually, some drivers are lazy....

plus ups claims is slow and mean, they try and deny

if there is not a signature then you will lose.

Does the tracking say anything about where the parcel got left? eg. in porch or neighbour?

I have a big window by my door and I can easily see out and they cant see in and often they do not even knock. My Fedex driver is the worst with this.... UPS often knocks and then literally runs to the truck...

a little whole a go i posted about a buyer who purchased an item from me while he was on vacation and it was stolen off his porch so he thinks somehow this is my fault .

just wanted to let everyone know he opened a case and ebay decided in my favor
