Default Does Opened cases count if not escalated to ebay?

My Listing was VeRo'd and removed because a buyer complained for copyright infringment. Now all the buyers were sent message from eBay to open a case if the item is not as described with no option to contact buyer.

As adviced by ebay, they all are opening a case now! My resolution is an immediate refund. But I was wondering, does the opened cases count towards DSR even If I did any immediate refund before escalating to Ebay for final decision?

Technically no but in reality yes, regardless of what their bs policies may say

Your account is now tainted and should be treated with great care as both e/b and p/p will have your accounts on their radar just waiting to press the fire button

YES...I had a case where I refunded immediately, it still showed up on my account. Had to call ebay to have it removed.

Yes the cases will count against you and it only takes 3 to put you below standard. Your only recourse is to refund all the buyers before they open a case. If you refund first then they cannot open a case.

Well to confirm this, I went to the seller dashboard for my last evaluation I clicked on cases & showed up the cases that they took into consideration.

However, I went to resolution center and checked all the "Not as described" & "Item not received" cases which didn't show up in the resolution center, all of them had said

"This case won't count against you when determining your seller standing"

^ This is only the outcome in some of the cases, these ones don't show up in seller dashboard under "Cases" and it doesn't count. While other cases I refunded immediately but it still counts?

Found the solution.

Only if buyer doesn't contact you & open a case, the case won't be counted provided you find an outcome before escalating it to ebay.

Starting in March opened cases will no longer count as per new policy change.
