Default On the buying side of things

As a seller I know things happen sometimes so I try to cut other sellers some slack before opening a case. I bought a set of books on 12/26 they were supposed to be delivered by Thurs Jan 2nd. Well there is still no notice of shipping and no tracking number available on ebay, I emailed the seller on Saturday the 4th to ask if they had been shipped yet, seller has still not responded to me yet I see that they have listed several new items each day so I know they have been on ebay so there is no reason they wouldn't have gotten my message.
At this point would you open an INR case or give them a little more time? I know this has been a hectic time for a lot of people so I don't wanna be a jerky buyer but my patience is wearing kinda thin.

Don't want to defend the guy but bear in mind that simply because you see new items coming up, it doesn't mean the guy is there looking at his ebay.
If I am not wrong there is the chance he has set up a programmed (delayed) listing feature.

First contact the seller - see what he/she says THEN decide on opening the INR...dont just jump on the claim opening without communication

Yea, I would contact them again. Politely ask them if they have shipped. Etc. After this amount of time. Without any tracking info or anything to go by I would give it the second message and another 24-36 hours then go down the item not received route.

By this point in time really no reason you should not know if the item has shipped or not.

To best honest. After 14 days unless they got back to me and had some kind of good excuse. If the item did not ship by now. I would leave bad DSRs at-least. Two weeks to hear anything is quite ridiculous.

Communication is the key (like alot of things in life i find can be sorted with more undisputed communication between two parties eh) Email the seller to his/her email that you sent the funds to if you havnt already as dont forget he might not check or missed the ebay email? Sounds like they are avoiding you though with listing new items. Email them more stating you aint gonna just leave it. I normally just send a polite remark stating i dont have to make a claim do i & leave neg feedback and 99% of the time you will get a fast response : )
I never leave neg fb as i always remember how bad it is to have done to myself. What goes around comes around i say so dont be too harsh buddy..

I emailed again on weds, as of today nothing from him but he has continued to list items and I saw that he left a bunch of feedback on Tuesday and I also saw that he got 3 neutrals and 1 negative this week, all said the same thing which was basically that he sold them something and never shipped it then said it was out of stock, so I think the guy probably sold me books he didn't actually have in his possession so I went ahead and opened the INR case last night and he has yet to respond to that either. I know as a seller it sucks to get cases filed but at the same time as a seller I also know that listing and selling something you don't actually have is just bad business.

OP, all of what you mention can be done automatically. The part I am not good with is that the buyer won't respond. I answer buyers on my gmail acct. from my Galaxy SIII. I would think they could too. If me and I didn't get an answer within 24 hrs. I would most likely open a case. Just know that USPS has a special low rate for publications which is very slow way to send an item. Also the whole country is just getting back to normal from the recent weather and flight delays.

I can't believe that I am actually using Amazon more for buying rather than eb. I check eb 1st and then find it cheaper on Amazon. I always get the best price and have now even looked at specialty ws for my needs with no better results yet.

An answer within 24 hours...from auction end? That's not a lot of slack time you're allowing...maybe a bit too rough...why not 72 hours
