Why not request measurements? I can spot a phake item that I have seen
immediately with correct photos. If you had done that you wouldn't have had
to go through all this right? Just return it and next time ask for appropriate pictures. |

| EWHendo | 04-21-2016 12:45 PM | Re: Question about Counterfeit Item and Return It was supposed to be a Lamy Safari Fountain Pen. I did not even know phakes existed of these before I received it and it did not work properly.
The seller was very specifically deceptive about it.
The listing was for the pen and an extra nib (the metal tip of the pen where the ink comes out, and that comes in different sizes to write different line thickness). The text on the nib that says "Lamy" and the letter denoting the line thickness are two of the main ways you can determine that the product is a phake.
The seller included a ziplock bag with a business card from a brick and mortar pen store and the extra nib. She claimed that she had ordered the extra nib online and never used it.
The pen's body and cap are phake. They don't weight the proper amounts, and have other indicators (that are only noticeable upon close inspection) of not being genuine. The nib on the pen is genuine though.
When i dipped the pen in ink, I found that it wrote a medium thickness line, when it was supposed to be a fine nib. My guess is that the seller found this same issue, ordered a genuine fine nib, and replaced the phake nib that her pen came with. The genuine nib that was on the pen had dents on either side, as it likely had to be bent with pliers to fit tightly on the phake pen. The pen also leaked ink everywhere when I put a genuine Lamy ink cartridge in it, something that a genuine would never do.
I confronted the seller with very specific images and descriptions of the issues. I included comparisons to genuine Lamy items that I had purchased from an authorized retailer. I think the inclusion of the business card was an attempt to make something she knew was phake seem legit.
I explained that the seller was asking me to believe that she had bought a phake pen that happened to have a genuine nib on it, and purchased an extra nib from an authorized retailer that happened to be a phake. The nib on the pen just happened to have dents on either side that look like it was bent with pliers, but I'm supposed to believe that was just from regular use.
She would not admit that anything was phake or fishy at all. I did NOT get a good deal on this. I paid very slightly less than one would in store. I am not at all comfortable returning a phake to her when she won't even admit that it is.
I get that you guys are sensitive about buyer issues, so won't ask again. I will navigate this on my own, and see what happens. |
| yankee | 04-21-2016 01:31 PM | Re: Question about Counterfeit Item and Return So be an adult for goodness sakes, get your head out of your ass and return the item like a normal, non scheming individual would. We are always sensitive about people who want stuff for nothing. I personally would go as far as to say I hate parasites. What you are trying to do is straight up ripoff a seller. You are a thief it seems. Just another person who wants something for nothing. You pretty much have proven everything we have said about people with your perspective of taking from people who produce and giving it to those who don't. |
| EWHendo | 04-21-2016 03:25 PM | Re: Question about Counterfeit Item and Return I really don't get how you think I'm trying to rip her off. She mis-represented the item, knowingly sold a phake, and won't admit to it.
Say you bought something from a brick and mortar store. You take it home and open it up, only to find out that it is broken. If you take it back and return it, you get your money back. You then watch the store put it back in its box and put it right back on the floor to be sold again.
Are you just totally fine with that because you got your money back? Do you not feel any obligation to future consumers to say or do anything about this? Do you honestly feel you are out to 'rip off' the store if you try to keep them from putting the broken item back on the shelf?
It seems that you guys really can't help but keep the political discussion from spilling over to practical matters, so I'll bite. You're equating my political philosophy of supporting social welfare with being a thief. I can't say I would expect anything less from hard headed right wingers. I view it as incredibly selfish to be okay with what this seller is doing, so long as I get my money back. That attitude aligns perfectly with conservative political ideals though. Screw everyone else in the world, as long as I come out ahead.
I would prefer to take active steps toward a society where people are good to one another. Despite your trolling, the fact of the matter here is that I got ripped off, and I do not want to continue the cycle of dishonesty to future consumers.
It is very sad that you're advocating a world where expecting honesty from sellers is a 'scheme.' |
| applepbc | 04-21-2016 03:31 PM | Re: Question about Counterfeit Item and Return you are ASSUMING so very much, OP. Its this ASSUMING and ENTITLED attitude that us sellers hate.
You need to return the merchandise and leave it up to the seller to decide to advertise it accurately next time.
You are not a super citizen and honestly, its a F*CKING PEN. jesus effing christ |

Just return the item, it isn't going against ebays policy for you to return it. If you're bothered about ebays policy then don't make stealth accounts either you plum |
| slapped | 04-21-2016 04:19 PM | Re: Question about Counterfeit Item and Return Man,,,I have not had time in the last couple of months to log on to the forum,,,and I see that the SAME OLD SH^T being peddled by the SAME type of LOWLIFE is still going on,,,,OP let me tell you something,,,,a seller who knowingly sells Phakes, is a lowlife,,,,,BUT, a BUYER who masquerades as a "Victim" (like YOU) for the SOLE purpose of stealing an item, in this case a pen, with Ebays help is FAR WORSE, in my opinion, I think that you should be SKINNED,,,,
It was already pointed out another member the ebay does not require you sending back the item, but ebay does NOT say that you cannot or should not send it back, the shipping back to the seller is being covered by the seller,,,so what is your problem?
I will add that NOWHERE in Ebays policy does it instruct you to destroy the item, so who the F^@k do you think you are?,,,Some kind of Cop?
Ebay deals with such sellers VERY SWIFTLY and PERMANENTLY. Then there is REAL Law enforcement. You are NOBODY,,,send the item back and mind your OWN Business,,,A$$HOLE<<< |

I didn't ask if it was "OK." I asked if it was considered risky from eBay's viewpoint. I also made clear that it was hypothetical, but that went completely ignored.
I'm not here for moral judgement, fortunately. If I never need to feel bad about advocating consumer rights, I'll know where to ask a justified question though.
Also, I get that it is just a pen, but this is a matter of principle. Just because I didn't get ripped off for much, doesn't mean it is okay for someone to lie to me. |

If a buyer suspects that an item is counterfeit, and there are strong indicators that the item is counterfeit, we don't require the buyer to return the item to the seller. The buyer agrees to cooperate with us to ensure the proper disposal of the item. In such instances, we refund the buyer for the full cost of the item and original shipping, and the seller reimburses us for the refund. The buyer may not sell the item on eBay or elsewhere.
Research, research, and research eh? |

Research, research, and research eh? | Hey JERKOFF,,,I CAN read,,,,,," proper disposal of the item" means that IF you decide NOT to send it back to the seller that you will NOT resell the item,,,,,at NO point do they instruct YOU to DESTROY it, they do NOT even want you to send it to EBAY,,,so do me a favor do NOT insult my intelligence,,
This is a sore topic for me because as a seller I have been the Victim of LOWLIVES like you, and I NEVER sold a Counterfeit,,,Dude you have NO FRIENDS Here, the best thing for you is to pack up all of your SH^T and roll the F^@K outta here,,, |
| EWHendo | 04-21-2016 04:41 PM | Re: Question about Counterfeit Item and Return Proper disposal of something just means that I won't sell it?
What have I been doing pooping in the toilet all these years? There are so many other ways to properly dispose of it!
No wonder I can never find nuclear waste on eBay... It's being "properly disposed" of!
You may be able to read, but you sure can't punctuate correctly dude. |
| JamesNorth101 | 04-21-2016 04:41 PM | Re: Question about Counterfeit Item and Return @Slapped - You have such a beautiful way with words!
@OP - Just send the item back and get your money back. Let eBay deal with the seller, that is not your job. | | All times are GMT -5. The time now is 06:06 PM. | |
