of course they could issue a temporary injunction but all this costs money , I doubt you will have anything more than losing the account
we have the same thing in the UK , taking people to court is tremendously expensive , there are exceptions for small claims but with what you have it would probably cost tens of thousands of pounds |

right now they are extorting sellers and trying to get hold of the frozen balances on ebay
you can abandon your account and it is good , I am sure there are people who would rather pay as their account is an important venue for them |

for now they just got an injunction which allowed them to get all ebay accounts restricted. the next step will be extortion of money from the owners of these accounts
those that do not pay may (MAY) be taken to court but I am sure they will not do it as it costs a lot of money , it is easier to just get hundreds more sellers suspended , a part will always pay
taking someone to court here is risky , they would need to prove that it is you selling the items , that these items are indeed infringing their rights , how many items you sold and probably more. it is just not worth it , spending money on this and the defendant may turn out to be a poor sucker who does not have this money anyway. USA counts as rich country but the vast majority of the population does not even have savings apart from a few thousand dollars |
