EBAY - your selling privileges are restricted

Hello everyone on this forum. I've known this forum for a long time and have gained a lot of useful information from it. Now it's my turn to ask the community for advice.

First of all, let me clarify that this is not a stealth account — all my details are genuine. Today I received the following email:

eBay regularly evaluates the accounts of eBay sellers. In relation to your account, we have noticed that your account performance and activities may cause high risk to the eBay community. To protect our community, we have applied the following restrictions to your eBay account in accordance with the eBay user agreement and eBay policies:
(a) Your selling privileges are restricted. Consequently, you will neither be able to create new listings nor revise your existing listings on any eBay site; (b) Your payments have been placed on hold; and (c) You are responsible for any outstanding eBay fees.
Restriction reason: High risk selling
The safety of our community is a top priority for us. We appreciate your understanding in this matter.

I haven't used this account for a while, but I don't think that should have any effect on this situation. I've sold about 20–30 items, and for one item of them I received a message stating: "Your listing was reported by the rights owner listed below as a counterfeit item." This came through after the auction had already ended and the buyer had paid.

I'm not sure whether this removal is visible to the buyer or not, but they haven't contacted me or requested a refund.

What concerns me most right now is that my payouts have been suspended. My main question is — is it possible to get the account reinstated? Thank you in advance for any information you can share.

I also received this email from eBay:

I want to inform you that your account was limited from selling due to the risk it exhibits to eBay and to its community. To help keep eBay a safe place for everyone, we sometimes find it necessary to place restrictions on certain accounts.

If it is determined that a seller is unable to fulfill their obligations to their buyers or if they pose a significant risk to the eBay community, we restrict the account's ability to sell on the site.

We regret to inform you but we won’t be able to restore your eBay account.

Additionally, regarding your concern about funds, I'd like to clarify that when an eBay account is restricted or suspended, we place a temporary hold on the funds to ensure that any open cases, disputes, or buyer claims are resolved. This holding period typically ranges from 60 to 190 days.

If your account becomes eligible for fund release after this period, you will receive an automated notification from our system prompting you to update or confirm your bank account details. Once you confirm the details, your funds will be released within 7 days, in accordance with your payout schedule.

Am I correct in understanding that nothing can be done now and there's no point in fighting for this account?

Feels like it's going to be tough to get the account reinstated - you sold 20-30 items and got 1 counterfeit strike...but were all the items the same or related?

To be exact, I've sold 20 items in total. 19 of them were tools, and 1 was a wristwatch.

This is not the first time I have sold items on this account. I simply haven't been active as a seller on a regular basis.

The tools...where did you source them? Trademarked brand...highly popular?

The complaint was for that watch. It wasn't a VeRO thing — just users reporting it, like it usually goes. These were not Rolex watches.

The tools were tweezers, screwdrivers, pliers, and collets — nothing unusual. There were no issues with the tools.

Don't quote me here but I'm pretty sure listings only get taken down after multiple reports now, unless the rights owner complains.

the watch was likely not cheap? most likely out of those 20 items the watch cost more than the other 19 combined and got a dispute for counterfeit so the ebay bots triggered a restriction

Right.... I don't see how it'll make sense for 1 bad actor to just report once and listings get taken down.

A seller can be banned for selling brand names ,it sounds like the watch manufacturer takes it down,Rolex is very active on Ebay and its lawyer will also send you a letter to pay fine,most people just ignore it.
It all goes back to the time when Tiffany took Ebay to court for false advertising-by allowing counterfeit Tiffany trinklets for sale,it lost the case as the court said it is the manufacturer job ,not the sales venue .
Since then Ebay has come up with rules like you (esp SE Asian sellers ) cannot list Tiff trinklets with more than quantity =1.
These days,many high end designers are active on EBay,Prada,Tiffany,Cartier,Meissen, nike ,Leica and who is the t shirt and hoodie makers,it just escape me.

With ROLEX,they dont even have to buy it and look at it,they just look at the pictures and take it down !,

OP said the watch was not Rolex - just clarifying.

Feels like there is more going on - some details are missing. But if the account went down just for 1 item...the complaint must have been big and detailed.

the only thing that helps the situation is that ebay is no good to sell expensive items in high risk categories , on watches I would not sell anything costing more than a few hundred dollars
