Are you saying in other words if I list a GI Joe tank from the 60s I am at risk of VERO? Maybe I would also be at risk of Hasbro because I violated intellectual rights by using the name GI Joe in my title.

So if we follow that very same logic if I list a "Chevrolet Corvette" on Ebay Motors I am at risk of intellectual rights violation from Chevy?

At this rate I will soon need permission/license to go to the bathroom. And a tax will be imposed on every flush.

Perhaps soon my local community newspaper will not accept ads for my "tank style" watch case or my "chevrolet corvette" since obviously I am an evil person that violates intellectual property rights/laws. http://i26.tinypic.com/24oc406.gif

I see Cartier eyeglasses frames on eBay by the dozens. I don't think these people are official Cartier people. What's up with that?

Actually when you think about it there may not be anything that you can sell on eBay because almost everything has a brand or name brand on it. I don't understand how they can get some people on this and not others. You know, Levi jeans, Ralph Lauren Polo shirt, Prada shoes, etc., etc., etc.

I had a Bottega Veneta handbag (real) taken down for using the term "like new". I was shocked that ebay bothered to tell me why they took it down. I changed the wording to gently worn and relisted with no problems. Well, till they suspended me for BRUCE SPRINGSTEEN tickets a million years ago! Get over it ebay!

There's for some time now been an option to report people who have their description, terms, etc. in a picture instead of text. Your listings could get taken down for that, though I suspect it would be less often than for VERO.

Hi,
This isn't really important, but just looking for opinions.
I recently sold a fountain pen, which is a replica
of a montblanc.
I never made any reference to montblanc in the listing,
I just visually described the item, though the montblanc
logo was visible in the photo, I didn't use the montblanc category.
The item sold successfully, for more than I paid for it,
but WAY less than a genuine montblanc, tiny fraction
of that actually.
Anyway, I shipped the item, and soon after it arrived
the buyer filed a paypal dispute stating that the item
bore a resemblance to a 'trade marked item', and was
of inferior quality. Subsequantly that paypal account was
limited, not sure if that's a coincidence, but it was a new
account and this was the only payment received (around $50).
So, obviously the buyer has spotted the photo, thought he
was getting the bargain of the century, and now having realised
the truth is screaming blue murder.
I can't even argue the paypal dispute, as the account is limited.
I am prepared to put this down to experience, as I knew what
I was doing when listing the item, but still... ;)
Can I recover the account from this ? Annoyed that it's a new
account with CC and bank account all added and verified, that
may be wasted.

Incidently, the linked ebay account is still up, with 10+ fb before selling.. so loathed
to throw this away too, if I can avoid it.

HI: I'd wait out the pp.. it may not be because of vero-- did the guy return to you?
I';d issue refund, send pp their docs and move on..
BTW-- there are SO MANY ⊗⊗⊗⊗ MB's--nowadays theyre moving onto ST Dupont, and Cartier pens, as so many ⊗⊗⊗⊗ MB dealers out there...
--p.s. take a look over on ioffer---- $10,$15,$25--- but theyre not from germany,theyre from China

No he hasn't returned the item..
I'm always happy to refund whenever a buyer is unhappy,
keeping my accounts up is more important to me than any
one sale.
Just kinda annoyed at this one, as his basic argument is
"it isn't a montblanc", when I never said it was... lol
He was hoping to get a steal from some poor sucker who didn't
realise the value of what they had, and it didn't pan out.
Yeah I know how many ⊗⊗⊗⊗ are out there, I just bought
a small batch of them to try it out, and although they do
sell reasonably well, they're not good enough copies
to pass for the real thing, so I wouldn't dream of trying
to sell them for anywhere near the value of the
originals.

It's true about the power sellers having power alright! A power seller got me kicked off for five days based on a false report! After I proved it was a lie...I asked Ebay to take action against the power seller for "ABUSING EBAY", "Interfering with the operation of Ebay" and obviously abusing the reporting system result = No response from ebay and Power seller account =Still active! I made it so obvious that it was 100% bogus...

They said I stole there picture and discription for an item...but get this ..the seller claimed I stole this from them in APRIL....My first listing went up June 10th! My account was non existant before May! I pointed all this out and so far no response...

Sadly, you'll get more response talking to a brick wall.

When was the last time you heard Ebay filed lawsuits against VERO members for falsely accusing Ebay members and damaging their members business?

Ebay is in it for themselves and to cover their ass from liability. Even though for 13 years they claimed they were only a venue and were not responsible for anything on their site.

If some sellers get the short end of the stick from this raw deal...well...too bad according to Ebay Legal. Sue us if you don't like it!

I just listed over 50 VERO items back to back
 
I usually only list about 10 items per day...IF ebay lets me without giving me the seller limit message. It wasn't giving it so I slowly started listed 12 per day. Then I went to 15. I figured my account would be suspended soon because I sell only VERO items and I usually always get suspended around the end of the 2nd month. So I started listing as much as possible tonight and I've listed over 50 listings of this item tonight. I've never scene this even be allowed for me before specially with the brand I'm selling. It's definitely weird. I don't know if the system's easing up with seller limits but I'm happy right now.

Yeah I was thinking that too. I really wouldn't even be upset...I have over $1000 in ebay fees on that account and I wouldn't mind abandoning the account knowing I took the $1000 as extra profit
