Default MC999 Out-of-stock listings have been removed

I havent been suspended... YET.. but eBay took down one of my jersey listings.
This is on a reinstated perma-banned account.
Monday I had a buyer ask to cancel a sale because I was out of the size she needed which I was fine with and had submitted a cancellation request to refund her. Shortly after, I read an eBay message she had sent with her phone number attached and I called her and explained to her I could order the size she needed for her son. Well it turns out that he actually needed a size larger than her original order.
Long story short she agreed to forget the cancellation and have me order the correct (LARGER) size for her son, but when I called eBay minutes later to ask them to remove the cancellation request that I had submitted moments ago they said after a few days it would disappear and not to worry.

Well today one of my best selling jerseys was removed....

MC999 Out-of-stock listings have been removed

- Listings with currently out-of-stock items have been removed.

You can find the listings we removed below. Also, while the listings are no longer available for buyers to purchase, you can still find them in the "Sold" folder of My eBay.We removed the items to prevent bad experiences for your buyers, which can affect your account standing. We realize you may not have been aware of our guidelines or that your items were out of stock.

To avoid inventory issues:
- If you no longer have any inventory available, avoid listing or relisting the item.
- If you're relisting an item, update the quantity to accurately reflect your available inventory.
- If you have only a few items in stock, avoid listing it on multiple websites.


Should this be something I should be concerned with because I am actually listing jerseys, then sending a thank you email to my buyers and explaining it may take up to 10 business days for me to order in their correct size due to being sold out earlier of their requested color or size. From there I order from my supplier and ship when it arrives.

I leave updates every 2 days or so with my buyers and stay in contact with them during the process and most are overwhelmingly OK with this.

Since ebay recently removed all of my other listings last week due to images taken from NFL.com and this being my 2nd MC999 in 2 weeks, should I worry ?

*Also I should note ...they didnt remove my other 2 jersey listings, or my non related item listing

Ok I guess I can answer my own question in the hopes that maybe later it will help someone else. I just called eBay and was transferred to Trust and Assurance and my record is spotless.
I was allowed to relist the item and it turns out that ANYTIME you submit a cancellation request and tick the box that says OUT OF STOCK...you automatically red flag yourself and can expect an MC999 and listing removal soon. The rep I spoke with said even though I had received a recent MC999 for images that my account was spotless and perfect and not to worry. Even though its saved... its not on my seller dashboard record as a violation so I'm good to go. I was pretty nervous for a good part of the day thinking I had just received my 2nd strike in 2 weeks.
I have relisted my top selling jersey and I'm happy as a runaway slave !
