Default What do you think about the lawsuit culture in the U.S?

I don't think there is an exact number on how many lives/people had been destroyed by getting sued in the U.S.

You see gangsters with law degrees going after businesses or individuals with one goal in mind ---> to make $$$. However, when that process nears its end, irreversible damage has already been done.


I can tell you something about Europe (i.e: Germany), this craziness doesn't exist


I think this culture might have some short-term financial gains to the lawyers and the people they represent, but long-term, it is destroying the country.

In US,if you ever get into a car accident,you can claim whiplash and get 4-5 figures but you have to share it with your lawyer,I believe they take 40-60%

Lawyers cost a fortune in the U.S in comparison to other countries. No wonder law schools are such a big thing over there!

That's really f*cked up if you don't have the right money to defend yourself in court


Look at Alex Jones for example, the man is being brought down by class action lawsuits. Such court system (in my opinion) is designed with one thing in mind, which is $$$.

One might argue that you could avoid getting sued by following the law and getting counsel beforehand, but that clearly didn't work for god knows how many people/businesses.

Universities find law school a money maker,the upfront cost is building a law library,after that,the tuition $ is pure income.
Pity the law students who borrow to get a law degree easily in high 5 figures and find no job or freelance work,many lawfirms are finding out one way to cut cost is to let contractors/subcontractors do the menial/routine work,skip the health insurance,profit sharing ,SS contribution,even overhead like an office,desk,chair?

People don't care what you're driving anymore in my wonderful southern state. If you're faulted for a wreck you can rest assured you're going to be sued in the next couple of weeks. Doesn't matter if you're driving an F-150 or a Ferrari.

It's sad to see. On broadcast TV during the day time there are nothing but ambulance chaser lawyer ads reminding everyone to sue thy neighbor. The lawyers are making tons of money so they won't stop until something stops them. I almost think the insurance companies and personal injury lawyers are in cahoots in some way.

In the UK whiplash and injury claims are a popular one. Solicitors love em. A nice little earner for them. We have indian call centres regularly ringing us asking whether we have had an accident recently and if we were injured.

Whiplash is a big one - neighbour got into a car accident, ended up with the other couple killed. He claimed whiplash as they have a big house and lots of $$$. Has to go to physical therapy for his "problem" but wont ever have to work again...

All too true. Churn them out. Bernie's free college would create such excess of "specialized" workers it would be impossible to find employment.

A lawsuit against you means little if you are "judgement proof" defendant.

In the context of contract law, debt collection and civil litigation, the term judgment proof is used to refer to defendants or potential defendants who are financially insolvent, or whose income and assets cannot be obtained in satisfaction of a judgment.

In other words, if there is little or no money there, you are unlikely to get sued in the first place. Lawyers and plaintiffs usually want MONEY and if it's not there to begin with, it becomes a moot point to sue someone. Litigation is very expensive and time consuming, and 99% of lawyers won't even take a case unless there is some $$ in it for them, or their client.

If you are someone who really does have some money, assets, deep pockets, etc, you need to "judgement proof" yourself BEFORE you have any potential problems. This can be done a variety of ways: use of legal entities; LLC's, corporations, trusts/estates, foundations, IBC's, and a whole host of financial instruments. The less you have in YOUR NAME, the better. In other words, REMOVE the INCENTIVE to sue you in the first place!

I wouldn't have this mindset, especially in America!

Of course, it's the lawyers job to scare you into thinking you could, and might get sued and hire them! The reality is, we are all human and cannot predict the future.

Do you drive a car?
Own a house/property?
Do you have any money in the bank, or other assets?
Retirement fund/IRA/401k ?

Unless you are homeless, without a job, or live under a rock, you can be sued at a moments notice for just about anything imaginable.

I've personally been sued more than once in my life, but I've come though it ok. One case concerned a tenant of mine in a rental property I owned, and another was a family (estate) issue. The later of which is far more common than you may think.

The sad truth is that greed can rear it's ugly head when you least expect. It's usually FAMILY that will sell you down the river most of the time. In fact, in civil litigation, Family cases are usually at the top of the list.

Someone dies, they leave the money to someone, and someone else will disagree. A divorce, estate dispute, and so fortrh. This happens ALL THE TIME.

Trusts ARE amazing tools, but only if setup and used correctly. They are pretty useless if a moron set it up, however.

There are actually ways of protecting your assets that go far beyond what a trust or foundation can accomplish. In fact, I can't mention it here because it's that powerful. Only a few people are aware of it, and it's 100% legal. Even Trump or Putin himself can't breach it.

This is why a really good asset protection lawyer is worth their weight in gold, that is if you have that much wealth to protect in the first place.

I WAS IN A CAR ACCIDENT years ago,two women were driving with expired driver license,expired license plate and no insurance,but I WAS in the wrong as I missed the stop sign,their car is a piece of junk,but they collected 40k,reason-whiplash !!!!!!

Seems unlikely.

Not sure if you live in the same Germany as I did.

Not without reason there is a German word called "Abmahnindustrie" which translates to "suing industry".

And I have been sued not only once in Germany. Actually "Beathe Uhse AG" sued me 20 years ago for 30k $$$ for ONE word on my website. That was the point when I decided to go to law school.

And I was sued thereafter can't even count the ridiculous amount of c&d letters which almost destroyed my entire business.

The gangsters with law degrees are all over Germany.

driving with expired driver license.
If they were penalised for driving with expired license and license plate and no auto insurance,that $40k will take care of all that!
