Correct me if I'm wrong, but as I read the rules on the US Customs website, it does not really matter if the items are ⊗⊗⊗⊗ or not. I don't think the customs service tries to determine whether or not they are ⊗⊗⊗⊗.
The website states that ANY trademarked or copyrighted materials can only be imported to the US with the authorization of the trademark or copyright owner.
That is why DHL told you that you needed the "letter of authority" from the brand owner.
One thing I know for sure is that if you have a package that is seized by customs, any other packages going to the same name/address have a much higher likelihood of also being seized.
Sure, a package could slip through (customs cannot check everythiong) but I believe (not 100% certain) they DO have methods in place to prioritize what they check.
The last thing you want is for several packages to be seized. The more packages you have seized, the higher the likelihood of having a legal problem.
For example, if ABC Brand Watches is notified that a single watch was seized, or even a couple of watches, you will not be very high on their priority list. If, however, you have 200 ABC Brand Watches seized, then you move up on their priority list.
My advice would be to be VERY CAREFUL with this.
