I'm quite the opposite, EMS shipments have never been seized. My first shipment through DHL got seized and destroyed, this happened about a month ago. It got held in Los Angeles, when DHL called me up and said that the supplier needed to provide a "letter of authority" from the brand manufacturer.

Three weeks later after the seizure, my supplier sent the item again through DHL and it came through fine. Maybe I just got unlucky. The package was around 46 pounds or 21kg.

To answer the OP I would open a dispute with the item significantly not as described. Take pictures of the item and send them to DHGate. If the payment has already been released, there is nothing DHGate will do but give you useless canned responses. If the payment has been released your best bet is to open the dispute with whatever method you paid with. DHGate will seriously not do a damn thing if they already released the funds to the seller.

I had a package shipped DHL 2 weeks ago which is currently being held by custom nyc. Someone in another thread said that he ignored the customs letter but 2 weeks later recieved a letter from NHL bc the shipment was jerseys. Anyone ever heard of this? btw, I once had an EMS shipment take 2 weeks to reach me. Both cases are ⊗⊗⊗⊗ DVD Boxsets, Im guessing they get checked alot

The NHL Gets notified as do All other Companies about their Prooduct being seized, it is up to them if they want to go any further, in your case the NHL Did go further.

⊗⊗⊗⊗ DVD's Get confiscated also, you would have NEVER have seen them if they were checked.

Correct me if I'm wrong, but as I read the rules on the US Customs website, it does not really matter if the items are ⊗⊗⊗⊗ or not. I don't think the customs service tries to determine whether or not they are ⊗⊗⊗⊗.

The website states that ANY trademarked or copyrighted materials can only be imported to the US with the authorization of the trademark or copyright owner.

That is why DHL told you that you needed the "letter of authority" from the brand owner.

One thing I know for sure is that if you have a package that is seized by customs, any other packages going to the same name/address have a much higher likelihood of also being seized.

Sure, a package could slip through (customs cannot check everythiong) but I believe (not 100% certain) they DO have methods in place to prioritize what they check.

The last thing you want is for several packages to be seized. The more packages you have seized, the higher the likelihood of having a legal problem.

For example, if ABC Brand Watches is notified that a single watch was seized, or even a couple of watches, you will not be very high on their priority list. If, however, you have 200 ABC Brand Watches seized, then you move up on their priority list.

My advice would be to be VERY CAREFUL with this.

Guess the EMS just came slow, but tomoro the DHL package will have been in customs for a week(tracking updates daily as 'clearance delay'). So I'll kiss it goodbye & fax whatever customs sends me to DHGate for a full refund. Am I missing anything?

I would try to work it out with the seller first. Its just common courtesy.

Most sellers will work with you to either re-ship the items using a different method, or will offer a partial refund.

Yes,you are right,you need to contact the seller,as they offered you CIF price,so they will give you some solution for this case ,refund half or resend some goods to you again .

yes, it's good idea to ask the seller refund half of the money , you know the best business is the long term and have benefit to both .

Yeah, I remember someone mentioning this in another thread. Something along the lines of if you know the risk don't let it all fall on the shoulders of your supplier.

An update real quick, I definitely prefer EMS over DHL still. EMS in lite packages will have a very slim if any at all chance to get seized. Anything under 50lbs is coming through with no problems.

EMS shipments once they hit the US get handed over to USPS Express and the USPS have never seized any of my shipments. Just look up the keywords "USPS seizure" vs. "DHL seizure" in the search box and you'll see what I'm talking about.
