Your defect rate is calculated based on your last 90 days of sales, just like it has always been.
I always recommend shipping with tracking, but especially now with the new standards. With the new standards if you ship without tracking, your buyer is asked when they leave feedback if the shipment arrived on time. This means all they have to do is say "no" and it counts as a defect for you. Very easy to be taken advantage of that way. On the other hand if you ship with tracking, you only get a defect if the tracking number shows that the parcel was delivered after eBay's estimated delivery date.
As long as you know how to manage your returns there is no risk of account closure for that reason. This would only be a problem if you commonly refuse returns and get cases referred to eBay, because "cases not resolved by seller" counts as a defect.
