L.L.C. creation & suggestions (sensitive)

I have an existing EIN that they already have as I was a fairly large seller before I was stricken from the face of the ebay earth.

So I would just go get a new EIN and business with the county clerk? I suppose the address would be a challenge as I believe the city will not create a business to a PO Box, it would have to be my address. And ebay has that address on their bad list. So that is a challenge.

As for name, couldn't I put any individuals name on the ebay account? Like a relative or friend or even Stealth? Actually it might be a good idea to put the individual name under the same fictitious but believable name as the business is created under like the Roger H. Hammersmith example you gave. They will believe it and when ebay discovers it I can always say it was an innocent mistake that I thought it was supposed to be the business name there?

Any other challenges with going back on ebay as a business? I am doing well with the individual stealth option but long term really need to be able to operate without the cat and mouse game again, so this would be perfect.

LLC with State, EIN with Treasury. You can use a P.O. Box for mailing, but must have a physical address on file with State. UPS mailbox works good, listed with state as apartment number instead of box number.

Don't put a random name on ebay. Use the name on the papers. Like the Hammersmith example. They won't know, and you won't tell.

You can go this route and be quasi-legit. Not sure why you would want to, but you can do it and still maintain some form of personal privacy.

Thanks for the terrific advice. I do appreciate it. It would be great to get business somewhat back to normal after being a real business on ebay for 8 years and having over 50,000 feedbacks. Then being suspended for a ridiculous reason and my whole world coming to a grinding halt because of it.

This is information I have not found previously and was hesitant to go to all the time and expense of trying it and then to discover I made a fololish mistake and have to start over. The cost of doing the LLC/EIN etc is lower than many would think. It's not so hard, and doesn't take long. Well worth it, for sure.

One thing not mentioned in this thread yet, is my other friend DBA. Toss that in the bowl with the others so far, give a stir, and you have corp cookies.

You can always give ebay/paypal a variation of your address. close enough you'd get mail with it but not close enough a bot would link it. I haven't done as Vic and named an LLC like a persons name. Now I've used a made up Persons name as a DBA of one of my companies to get bank accounts that I could cash checks and stuff in those names but that was before when ebay allowed checks/mo as a payment method. So I don't use that one anymore.

Thanks for the guidance. I wasn't sure if the business license had the address printed right on it and had to be faxed to ebay at some point, therefore creating a problem. Manipulating my real address is a great idea, I will have to see if I can work that in as I can't use my address and don't want ebay to discover I have gone stealth as it would remove any possibility of their reactivating my account in the future.

Yes, I remember those good old days of going to the bank with a stack of money orders... lol. Now we have to squirm every time we make a paypal withdrawal of our own money that the phone is going to ring with their paypal police and their "questions".

The county clerk has nothing to do with setting up an LLC. The states do that. You can LLC in any state you wish, as long as there is an address in that state where you can receive physical mail. They do not like P.O. Boxes. You can use a UPS box with suite or apartment number. They don't check.

DBA is abbrev for Doing Business As. It's a piece of paper that says you have a real name and a legal pseudonym. Only thing you do with that, is have checks made out to the Roger H. Hammersmith name. Take the checks and the DBA to your bank. Sign the check as Roger H. Hammersmith. The money is yours. You never put your real name on it.

By the way, can you use a different address with a LLC? Ebay has my home and warehouse address already from before the suspension. And when I called the county clerk a while back I am pretty sure they said the business needs to be set up to the address on my drivers license. Ideas on overcoming that?

I will have to also learn how to utilize DBA's in this. Its a new land for me, lol. But baby steps can lead to great places.

you can do your license correct then when that time comes to fax it in to ebay photoshop your "changes." Yeah no kidding on the squirming when you make a withdrawal. I'm so glad they did the plugin. I shoot most of my money out through the virtual credit card now. cost me an extra 2.5% but at least I'm getting my money before I ship.

LLC and DBA are legal way of being sneaky. No need to PS the docs. Just use black marker over your real name, if you ever have to go that far.

DBA allows you to BE a different legal entity. So, you DBA as Roger Hammersmith, you ARE Roger Hammersmith. No need to sneak. Be legal.

Now do you see what I was saying earlier as regards RUNNING YOUR BUSINESS LIKE A BUSINESS? This is how the big boys play.

Damn I feel like I should be sending you guys tuition! Thanks for all the enlightenment! I wasn't familiar with the difference between the business license and the LLC. Thought they were basically the same. What you explained makes perfect sense now. I have a UPS store 2 blocks away so that would be perfect, it looking like a real address. as far as a DBA in another name, so simple, yet so effective, and downright cool! I have to do this......lol. and will.

For doctoring the address, I have Photoshop so that shouldn't be too hard to do, once I learn my way around it. Or find a friendly kinkos employee, lol.

As far as withdrawals I try to time appropriately when I do them. The verification call seems to come very quickly when it does, so with planning its unpleasant but doable. I have not done the paypal plug in. I will have to do some research on that. As this is all just about 3 months old for me I have tried not to take technical chances where I could screw up and not figure out where my mistake was. But in time I will get up that knowledge and be ready. It would be great to get access to my own money without the fear of Oz questioning what I am up to.

You know if all this works I wont have to carry 11 phones anymore for fear of missing a paypal call, lol. No more swerving across lanes of traffic in a panic trying to discover which phone is ringing, and who I am supposed to be, before it stops ringing. Does it get much better than that?

I see exactly what you mean about running it as a business. This is a completely legit way to get back on ebay, and get my business back. It is one thing to have ideas that it can be done, but another to talk to people that have understanding and confidence and who know it can be done.

Yeah I mean look at the big boys as vic put it. they come out, completely screw up the world. set up a new corporation and do it all over again. thats the glory of business. You can make a huge mess out of everything and start all over with a clean slate.
