Default Paypal chargeback outside ebay

I have a bit of a pickle and I only have a few days to make a decision...

Basically, I had someone pay me $xxxx (in the thousands) with Paypal and after 80 days has filed an item not received. The Paypal account now has a negative balance and I can't delete my bank account from my Paypal account.

The Paypal account is stealth. However, I'm not sure what I should do at this point considering the transaction was outside of ebay, and I have already withdrawn the money from my Paypal a long time ago.

I didn't add any tracking details, but on the other hand, no invoice was issued to the other party.

Why would they wait 80 days? .. why would you have no tracking?
why no invoice? all sounds a little dodgy to me

Sorry OP not enough information regarding the sale. What was it?, how was it delivered?, Why no tracking?, why no insurance?, Why would PP not see it as money laundering? Have you spoken to the customer? Have you emailed the customer? How many thousands are we talking about here?

And then of course what is your account worth to you.

No information = cannot offer any help. Sorry

True while there are no details, is the account in your REAL name and info? You can expect pa yp al to come after your and your credit score with collection agency.

First step is prob best to close the bank account tied to your pp so they don't try to dip and cause you NSF fees.

With PayPal, it is up to the merchant to provide some sort of proof of delivery. If the item in question was "in the thousands" then you should have shipped it INSURED, SIGNATURE CONFIRMATION REQUIRED with TRACKING.

The bottom line is, I don't see you winning this. PayPal will try to debit your account on file for the money. There is no way to delete an account from PayPal. So, the only thing you can do is close the bank account.

One potential problem here is the amount of money involved. If they investigate, they COULD try to convince a government prosecutor to file fraud charges. Whether or not that would go anywhere I don't know...

Well, its a long story but to cut it short, the buyer wanted to pick up the item, and I was desperate enough to accept Paypal because they apparently didn't have the cash upfront. The item was sold for almost 10k.

I have no idea why they have waited 80 days to report this. I haven't heard from the buyer since the transaction. I don't care if the PP account is closed, but what I am concerned about is being hunted down by the law.

Its a stealth PP account, but the bank account is still linked to it.

The last thing Jeff mentioned is what has been playing on my mind, because a lot of money is involved and I don't think PP or the bank would walk away without a fight.

I cant believe someone paid 10k through PayPal without seeing the goods and you sent it without tracking and he waited 80 days before contacting you and this story is unbelievable and what was the item without cutting it short?
I don't think PayPal will refund the client as this look so dodgy

The item was picked up, not sent. So, they had the chance to check it before parting ways. I don't think we are on the same page, basically the chargeback is initiated from the bank, not Paypal if you follow me.

This is an excerpt from the e-mail I got from p aypal:

"Hello XXXX,

We were recently notified that one of your buyers filed a chargeback and
asked their credit or debit card issuer to reverse a payment made to you on
XX XXX 2011.

The buyer claims that the item wasn't received. Their card issuer needs
additional information from you about this transaction."

This is what you have to put up with when people can pay via their Credit Card.

It is possible for PayPal to dispute it with the credit card company but I really don't know much about this.

What was the item and was it a genuine sale? i.e. perfectly legal re-sale (I'm guessing a car or equivalent).

The real issue here is that the guy is either not happy with his goods i.e. he later found out that it was a false sale/stolen goods etc and wants his money back.

The other option is that he is an out and out crook and is attempting to commit Fraud.

There are so many questions that need answering with this one. Maybe it wasn't even his credit card!!!

How much of your own money was swallowed with the negative balance. If it's less than a grand I would just walk away and let PayPal try to find you...which if your stealth then you have no worries. You can't fight it as you broke terms and conditions by not having 'proof of delivery'.

^ It is not in their terms and condition that you 'must' provide tracking. If you do not provide tracking/somone picks the item up from you, you simply do not qualify for seller protection. The item he sold may also mean he never would have qualified in the first place i.e. a car.

@OP, have you contacted the buyer yet? that would have been my first move.

I think the guy was happy at first, but probably has bills now and is trying to recover money nomatter what he has to do or hurt!

personally i think he planned it - perfect for him. Pay by paypal using a credit card that easily allows chargeback. Pick up item himself - no delivery address needed.

I don't understand why when you guys have somebody pick up something why don't you guys take a photo of the person real quick? I mean picking up an item in person has to be the dumbest thing you could do since you could get caught?

Not sure what you would do with the photo?!

IF it is a scam, people can send a third party person to pick up the item on their behalf.

Their are a many different possiblities here, let's see what the OP says, I am actually very interested to see where this goes.

with the photo you could have some kind of evidence at least. or people make people sign for **** and record the video for chargebacks!
