| | | GreenBean | 04-21-2012 06:27 PM | Comes down to BUYER BEWARE.
Sellers looking for goods to onsell have a responsibility to THEMSELVES to ensure such goods are acceptable to be sold.
Simples. |
| Callidus | 04-24-2012 01:54 PM | UPDATE:
The agent for the company obviously received the item but have opened a case on eBay, stating they have changed their mind and would like to return it.
They have also put a message in with the case, it states; "Dear Seller, Thank you for my recent purchase, which has now arrived. However, my daughter seems to have changed her mind, and decided to purchase a different item in a different colour. I am happy to post this back to you, however, are you able to give me your address to post it to? Sorry for any inconvenience caused, please inform me when the amount it refunded. Looking forward to your reply."
This account was my first ever account I made when learnt stealth and the address is a shopping mall address with a made up name.
Do I accept or decline the return request OR any advice on what to do? |

Do I accept or decline the return request OR any advice on what to do? | Email them back telling them that they can have the refund and that they don't need to return the item.
Accept the return case and then immediately process the refund.
They can get you stealth address easily anyway by requesting it through Ebay, so don't worry about accepting the return.
Are you continuing to sell said counterfeit crap or have you removed the listings from Ebay? |
| Elijah | 04-24-2012 02:20 PM | Why the heck did they open a case? I thought that you are under no obligation to accept a return for change of mind, so no case is possible in this instance. |

They are getting his details so they can send the nasty demand letter. |
| Elijah | 04-24-2012 02:26 PM | Yes, and it still does not make any sense to me. Couldn't you just decline it since it is just for a "change of mind"? |

They are getting his details so they can send the nasty demand letter. | That demand letter wont come to me anyway it will go to a shopping mall address that was setup on this stealth. Was my first stealth I made when I didnt properly know how to setup so I will never know what the letter says.
Have read that they say not to ever sign for a letter like that etc.
Oh, Ebayorbust - Don't think you need to ask questions like have you removed the listings etc, not stupid enough to list more, we all do things then learn NOT to do them, thats life my friend! |
| NoneOther | 04-24-2012 02:36 PM | @elijah
NO, if the item was sold using BIN or Best Offer then distance selling laws apply.
Even if it was sold at auction then if they open a case e/b will find in their favour 99% of the time regardless of reason for return. |

It has been said already on the thread that if they want to get to the real you, it can easily be done.
Good luck. |
| ovidiu | 04-24-2012 02:52 PM | What I think (and I am from the US, keep that in mind).
They don't want to work hard at getting your info with court order, lawyers, all that. That stuff costs money. So it looks like they want to a) get your real (return) address out of you, and b) maybe find out if you're selling other varieties of phakes like different color/style.
As another person mentioned, just issue a refund and tell them they can keep it. Dont be under any illusion that the stealth address will protect you. It has been said already on the thread that if they want to get to the real you, it can easily be done.
True, but apparently this company is looking to get his info the easy way, so if you put up some obstacles, they may just get your account suspended and leave it at that. Consider that a cheap lesson. |
| NoneOther | 04-24-2012 03:00 PM | I would guess they already know or at least strongly suspect the registered address is bogus (its not that hard to check really) and are trying see if you are going to give up your real address.
I also think there is a definite sense of purpose in what they are doing and that they are planning to pursue this. |
| Callidus | 04-24-2012 03:05 PM | Thanks for all the tips & advice above.
Other thing I dont get is, there is 2 other people that are clearly are selling phakes, he has over 500 feedback of this product and they're not investigating that seller?! I mean 500 fb, can you imagine how many he has sold if its a 1 in 3 fb ratio!?
Just doesnt seem right for myself having only sold 100+ that they try me and not that person.. I know doesnt pull the spotlight away from me but just thinking out loud |

That's not really a good assumption as they may well be in the process of taking down everyone who is selling ⊗⊗⊗⊗ of their brand |

That's not really a good assumption as they may well be in the process of taking down everyone who is selling ⊗⊗⊗⊗ of their brand | Well they have about 25,000 listings of other products that are available that are CLEARLY been ⊗⊗⊗⊗d on eBay...you telling me they will take them all to the cleaners? |

| Killuminati | 04-24-2012 03:56 PM | The reason why they want your address is because they can send a letter demanding money and a large sum it is usally a scare tactic |

Do I accept or decline the return request OR any advice on what to do? | Interesting how the person wants a return - with a made up story?? hmm maybe they know you can tell who they are just by the name.
Obvious tactic to get your address, but they can go through ebay in obtaining an address, perhaps looking for a faster way of dealing the matter at hand.
Another thing that just crossed my mind could this not be some competition messing about with people?
I think you should check the address you sent it to again - tap that into googe see if you can get street view image or just google the address see if anything solid comes up bro.
Just a thought. :bored: |
| Killuminati | 04-24-2012 04:07 PM | If you have sold alot they can take it further to the court and go through all your transactions for proof and evidence and plus they also have the item but remember they need to put money in to this |

Just a thought. :bored: | I seem to remember he already checked the address he sent it to and it's the company's registered head office. I think he also said the email address for the buyer was from the companies registered domain name too. |
without reading the posts!
like ebayorbust said, let them keep the item, refund in full, send em a nice message and be done with it
move on,not worth the risk davey |

They don't need to take it through civil court, that would only be for breach of copyright.
Selling ⊗⊗⊗⊗ goods in the UK is a criminal offence, by involving the appropriate authorities it could well become a criminal matter. |
| Callidus | 04-24-2012 04:16 PM | Thankful, I got a vero warning a long time ago and was told to contact the same email address of the person that has bought from me.
It isn't someone messing about.
GTB - thats exactly what I will do, just reject the return, tell them to keep the item quickly go onto Paypal and click refund and be done with it. |
lay low for a while lol
all the best |
| Thankful | 04-24-2012 04:21 PM | Yeah gtb is right man lay low to show them your done with it. |
| mercurial333 | 04-24-2012 07:21 PM | Couldn't image selling this stuff. Having to deal with Customs problems, Ebay trying to take you down, the Vero member trying to take you down, other law organizations, customers trying to take you down.
It's like all the little kids want your pie, lol |
| BiN4RY | 04-24-2012 07:36 PM | Go to the post office asap and fill in a parcel recall form. Your item will be returned back to you if it hasn't been delivered yet.

Sent from my DROID3 using Tapatalk 2 | How many times has that worked for you? Failed for me every time. And the clerks didn't even have the slightest clue what I was talking about. None of these retards even know packages can be recalled. Either way, it's been a useless effort. |
| LoopHole | 04-24-2012 11:32 PM | Something like this has happened to me when i was 14 and selling on eb*y. Being very young and not knowing ANY of the rules i came across something like this. I sold f*ke branded items under my dads name which had an SSN attached to the account. One day i get a letter in the mail from a lawfirm that was 1 was page long saying i was being sued for $15k. Behind that letter were about 100 pages laws and property rights all that good stuff.
Being 14 and scared sh*tless i never showed this to my parents. I ripped it up and threw it away. Maybe it was my luck, but there were no further consequences. But i tell you this..... my balls were shaking every day for about 2 months when i saw the mail man come. |

Good deterrence.
But i've seen alot of companies buy undercover - i guess different companies different method. | exactly, probably a scare tactic.....
if they wanted to proof to build a case would be more incognito.
they have brand name email and are making up a story about wrong colour, something does not seem right, they either want an easy way of getting address or just spooking him, either way I would refund and ignore, does not look like they are going to go thru the hassle of getting your bank details and trading standards, this is UK,...you US guys have no idea how much slacker things are here.... |

Thanks for advice guys looks like I am well and truly done with ! | Im in the same boat right now! Luckily I noticed the necessary info to cancel and stop selling that item |
| Sneakee | 04-25-2012 03:59 PM | So did you refund him yet?
Wouldn't it be easier to just say you don't take returns due to buyers remorse and just leave it at that? |
| Callidus | 04-25-2012 04:14 PM | Refunded mine told her to keep the item and I dont want the item back, I await a response and will keep people updated for sure |
leave that account to rest up for a good few months and when you come back to it make sure you got some nice legit inventory to sell on it |
| KingRay | 04-26-2012 12:22 AM | Long post but gotta get my word in ..
If this is in regard to the #H# Flat Irons by chance then I would take it very seriously. The Fa#### Company has tons of info digging tactics and have for about 6yrs now. Ignore until they send you something Certified Mail. Or show up at your door. Until then its just speculation really.
Quit selling them now and dump your stock. In ways that cannot be traced. IE. Throw them in the trash. Dont be stupid and sell them on CL cheap in one lump. worst you could do. almost I guess.
You really have 2 choices, Do what I said above and just worry when something happens, if it even goes any further.
OR. If you know you are busted for sure and want to just try something before they get too deep into your info themselves::
Just contact the company directly and ask them if you can speak to them regarding the product you have and its authenticity. Ask them to take a look at a sample you have to verify it. Knowing its crap stuff, tell them you had one customer say something so you were curious. Say the last thing you want to do is sell crap products. You will have to do some real creative lying to cover your past purchasing tracks. Then they come back saying its crap merchandise and let them take what you have or send it all to them voluntarily.
That option is a big gamble and some will simply say that is stupid as hell BUT, That has been the way out for some and its much better than the alternative of letting it get too far and having them come to you on their own.
Not sure how big of a company you are or how much product you have but if its truckloads, I would go with the voluntary situation. A lawyer will surely help you with this. Charge you ridiculous amounts of money but Fines come with a record, The loss of product voluntarily is just the cash loss. If you are selling tons of them, a few thousand in retainer fees wont hurt at all.
I know several will weigh in on this post but it is what it is, trust me. Its not a secret and this specific info is out there.
Good luck but you do deserve a bit of harassment from others on here. would you want a cheap knockoff?
Call a local attorney and talk to them. Wouldn't cost much to do that. They are there to help you get out of F'ups. |
| Callidus | 04-26-2012 01:03 AM | Not quite sure what you mean by Flat Irons nor do I know which company you're talking about can you elaborate? Maybe PM me, to be honest the company i'm talking about doesnt seem to be the same but just to clarify let me know which you are talking about |
| Callidus | 04-26-2012 02:01 AM | Oh no it isn't what your talking about I'm talking about iPhone 4 accessories that I was selling for £13.99 | | All times are GMT -5. The time now is 10:52 PM. | |
