Default Help please worried friend: MC019 Listing policy violation alert: Copyright Violation

Advice please, a friend has had a listing removed at the request of a film company via eBays Vero, he was selling a DVD-R version of what he thought where public domain films from the 1940’s! Lots of other people selling the same set on eBay and have been for a very long time, films starred a particular Ukulele player!

Oddly enough they quoted and removed 2 listings , 1 listing was the current listing , the 2nd listing was the previous listing ....that I found a bit odd as the 2nd listing had finished some weeks ago !

His eBay account is still working and he has not been banned , though his policy compliance is quoted as been "low"

He is now very panicked , he has sold around 40 sets or so over the past few months , he now understands he’s been a bit stupid for not reading up more about U.K film copyright law , which basically states that all films remain in copyright until 70 years after the writer/director / composer dies , he had read other eBay sellers listings and seen how many they had sold and how long they had been selling the films , so he thought he would jump on the band wagon , basically the blind leading the blind.

He is scared he may get a visit from the police and maybe have to go to court.

I have said well perhaps it is just a routine thing, the Vero owner has requested the item to be removed and that should be the end of the matter and not to do it again.......the films where from the 1940’s not the latest blockbuster, I know the law is the law etc, but I have said perhaps with the films been from the 1940’s that most likely will just be the end of the matter.

There are still plenty of other sellers , still selling the same DVD set he was selling on eBay and other eBay sellers have not been removed ...........has anyone had this kind of thing happen to them before or any experience of what may or may not happen....just looking for a bit more info to try and help my friend.

Police visiting is very unlikely. If he is that worried, I would advise speaking to a lawyer but I have in the distant past had these notices and never had anything come of it (other than a few buyers trying to claim their money back by claiming non delivery the little sh.....)

A business on eBay cannot be based on what other people can and cannot do. Simply doesn't work because you do not know their circumstances. The other sellers could have the rights holders permission for all you know.

Ebayorbust, that made me laugh - yes the friend...OP, tell the friend to join up for advice.

Anyhow, just because other sellers get away with it, doesn't mean he/she/your sales will be allowed. Lot of research and experimentation needed.

Only real advice here is to NOT repeatedly attempt sales of this product on this account unless getting clear rights to sell. Maybe the friend got reported by competitor or buyer or eBay itself caught the account.
