Go to the Site Map , under Selling Activities there Manage Bidders. Add his name there.
If he's paid for the item refund him saying no stock.
At one time buyers who hadn't paid couldn't leave feedback.

As long as you don't relist the item once he leaves negative just call or email ebay and ask them to remove it.
Live Chat may be the best option to get it done quickly although last time I tried it was difficult to get to Live Chat.

Recorded items will have a weight on the slip so he will be able to show ebay the package was empty.

You should have added him to Blocked Bidders the second you got the refund request.
I know that doesn't help now but its worth remembering. I add bidders to my blocked list the moment they make an unreasonable complaint or comment. Better safe than sorry
