If an item is purchased from ebay but never despatched by the seller and not refunded by the seller as they have allready withdrawn / spent the money in their paypal account what will happen ?
Say the buyer opens a dispute, but there is no money in the paypal account for the refund, so after 21 days , would paypal have to refund the buyer out of their own pockets ?
Or would the buyer get nothing ?

The Paypal account will go into a negative balance if their is no funds - Only if the transaction is backed via eBay's and Paypal's buyer protection - otherwise the buyer will get nothing and then the Buyer would have to get the Police involved for Fraud - Police investigation's can take anything from a few months to a few years considering if both parties live in the same country ie if the buyer lives in the U.K and the seller lives in Australia then the UK police would have to wait for the Australian police get's involved.
