Hi everyone, recently an item that i have been selling for around 4 years on ebay on a good till canceled listing was removed due to copyright. Now i know i would be foolish to relist the item again but would you think it would be ok to do so in say a year from now? thanks

No.
Once removed, it will be removed again.
Either never list it again or obtain the rights to list.

You must obtain the rights in WRITING from eB. Do what is needed to get it if you can.

If you must give advise try to give as close as possible to being correct that you can manage.
ebay ALWAYS instruct the seller ( if they even bother to reply) to get the consent of the RIGHTS holder.
Stop with misleading info . |

When there is a VeRo take down, the seller needs the OK from the rights holder.
Problem is that with a UK listing you may never get that permission. ebay UK also do not allow sellers to file a claim disputing MC019...
Seems like you came up against an aggro IP holder....did you make a formal approach?

You will need to get permission from the right holder before you can sell that item again
Just because other can still sell it does not mean that you can, they may have the right holders permission.
Dont relist this item again unless you get permission in writing.

They emailed back saying that any 'Jaguar' branded items using the logo or there name are not to be sold and that they take it very seriously. Even though there are over a quarter of a million 'jaguar' related items on ebay.

That company is known to be 'hard' on enforcing their rights .
Know of someone whose account got killed for listing a Jaguar key-ring.
Not 3 quid of merchandise but no account....
Absoultely proceed with caution here.

There are also those sellings that just havent been caught by Eb yet.
Ebay can go 90 days into the past - pull listings - warn buyers - issue suspensions on that - and make the seller suffer.

The sad fact is, when it comes to trademarks, the rights owners have most of the power. Some rights owners would prefer their products were never sold on eBay. So, even if the item is legitimate, they have it removed.
You COULD try to sell it on a different account, but you would have to make sure that EVERYTHING about the listing is different - pictures, description, title, etc.
And, there is no guarantee the rights owner would not remove the new listing as well.
But to re-list on the current account would be inviting account suspension.

I have had the same restriction happen to myself. Listen to the Bay and DO NOT continue relisting, especially if you think you will get away with it "just one more time". You will get MC'd and back on the Forum you go.
I have been waiting for a little over 1 year for my particular catagory to be revised. I know that it will, but I know that I have to wait patiently on the Bay.
It has been VERY tempting, but please wait for the Bay to give you the GO. It may take 2 or more years for them to revise and update your Catagory, BUT it is out-of-your-hands, so just sit back and wait.
ALSO, keep all of your Contacts and their e-mails! There is life and Sales 'outside' of the Bay!!!
