@OP
When you called, what did eBay say and is his listings still up? Did you happen to message the seller and ask him to elaborate on his "item condition" and his difference in the "description" area?

When I spoke with the ebay rep he stated I was completely justified in my complaint and stated he will report the seller asap and understands its obviously unfair to other sellers who are accurately describing their listings.

I really dont understand all the negative responses from my post..my complaint is nothing unusual...I am not trying to ruin someones career....I am simply asking ebay to enforce their rules properly.

Re: How is this seller NOT in trouble?

The bulk of the negativity is because you called ebay on someone, which could be a stealther. Its just frowned on here because of all the stealthers. Everyone is trying to make their licks here. Its like a Stealthers Code.

you do not have to buy it, mr gaureenting.....

selling accs is allowed on the forum by approved sellers, for those who need them..

where does it say about the phone issue?

Any phone number added to paypal when the account is created can be easily verified. Its when you try to add a different phone number to paypal that the phone will not work for verifying withdraws or sending money.

Please start your own thread.....this thread has NOTHING to do with Phone Number Verification.

This guy cannot be serious, this forum is about helping others, you haven't contribute one once of anything to this forum but all you want is to bitch and moan and ask for help. question after questions people on this forum has helped you pretty much spoon fed you the whole way, and the first thing you can do is report other sellers? hopefully you fail in your stealth ventures all you will in everything else you do in life from your attitude.

Did you even read the original post?
Jesus christ some people are truly dumb..this has nothing to do with a stealth account.

Re: How is this seller NOT in trouble?

ok guys....everyone is right and I am wrong about everything Ill just list all my products as brand new also and I wont care about ebay's rules about anything sounds like a solid plan.

Oh and while I am at it ill lie and say I am an apple authorized reseller too..and reseal all my items so they look like theyre factory new...that ought to work real good since nobody here seems to care about selling honestly.
Thanks for all the great feedback everyone, super encouraging.

Why dont you be honest and never sell on ebay again.

The worst thing is that most people played by the rules 100% before being shafted and ending up on this forum, sometimes you have to play the game that other sellers are playing.

Playing nice doesn't get you results, even large corporates don't play nice!

Retailler77, I understand that it's really unfair when other sellers don't play the game with the same rules, and that's why you reported him. Even if you had many negative feedback, i think you are not the only one to report competitor, because that's only buisness and people does it everydays, and not only on Ebay or Amazon but everywhere.

But instead of reporting him, you should have contacted the seller (like mentioned before) because as you can see (18000 feedbacks), his buisness runs very well. Then you could analyse and learn about his method in order to do the same buisness yourself and then reach 18000 feedbacks.

You would earn more by learning than by reporting.

The guy sounds like a professional. Surely he's got several more high feedback accounts. He's also probably sold Apple all along on his account making it risky to shift to another niche.

You're a douche for trying to report him. People have families to feed.

I hear what your saying, and respect it.
It's just such a fine line to play with ebay and I would rather play it safe and list honestly than risk my account going down by false advertising you know?

ok...and I dont have families to feed?
Why should an honest seller need to work 4x as hard and sell 4 items to make the profit hes making from selling 1 item because of false advertising? Whose the real douche in this situation?? Cmon man..

You, because instead of moaning you could of worked out what he is doing and do exactly the same :) Everyone is telling you to get on the bandwagon but you don't seem to want to listen.

Re: How is this seller NOT in trouble?

It should also be said that you're completely wasting your time, eb puts very little value in lone wolf reports/rants, whether you call them or do it via 'report item' page.

In general, for any action to be done to an acc (especially an established one) that isn't listing prohibited items or listing in the wrong category, it needs to be the rights holder or more than 5% of recent customers need to start complaining.

You're accomplishing nothing here.

I think you are right Vetus, I am just gonna start doing the same thing, since ebay seems to not care about enforcing their own rules. :fight:

See...now your getting it, why mess him up when you can be doing the same as them and profiting. You may think your being a hero but you gotta ask, "am I messing it up just for him or myself as well".

OP! I can understand your frustration that the other guy is selling more iPhones and probably making more money than you... But like others advised here, it's always better to learn from others' experiencing than bringing them down too. Don't be like "frogs in a well"...

you're also not suppose to sell virtual goods either but there a ton of sellers that do, are you going to report all of them too?

His feedback is nearly 18,000.

Here is the description for ebays "new" items:
New: A brand-new, unused, unopened, undamaged item in its original packaging (where packaging is applicable). Packaging should be the same as what is found in a retail store, unless the item is handmade or was packaged by the manufacturer in non-retail packaging, such as an unprinted box or plastic bag. See the seller's listing for full details

When you scroll down to the sellers description it states the following:
Brand New Unused With Open Generic Box,
9/10 Condition

...not adding up
