Default Problem because of foo-foo item I sold

Well, I sold an item to someone. He's given me nothing but trouble. The thing is, the item ends up being counterfiet (how the hell was i supposed to know?)

I'd refund his money, but I don't have it. I'm a student, and really short on cash. Short as in none at the moment.

The upside is, he filed a case against me and lost. If he tells them about this new situation, will the pursue it or even allow him to open his THIRD case? He also contacted the company.

I'm scared.. and I dont know what to do.

Was this on ebay?? as you are refering to a company? or is it the company that supplied your product?

Regardless if he had a case open and ebay decided in your favour, then case is closed.

He can however open a 'sales under false pretenses' (fraud) case against you at the police station, especially if it is ⊗⊗⊗⊗ and was sold to him as original.
The only way out of that one is that is to show the police the proof of purchase of your product from your supplier which shows that that you bought it showing it was original to clear your name. If you bought it and it says it was ⊗⊗⊗⊗ then you will lose and can be prosecuted.

Also if you no longer have the funds to refund this buyer, then that is not the buyers fault or problem and you would need to find another way to get the money to the buyer.

Funny how so many people come on here and have the same story, how would you not know if something was a BS item?? Plus if you sell it then you are responsible regardless. and the thing about not having money is BS. man up and pay them either way. I would probably come after you in person if I was sold something and the seller blew me off. Not the best option but I'm one of THOSE......

Sellers have to be responsible for checking items they sell are OK for sale. Ignorance is no excuse. That fact is addressed here many times.


You have a responsbility to work out a plan to reimburse the buyer.

More info as to where the item was sold etc is needed

refund the guy and apologize. its the best thing. if o not have the $$ go sell some of ur stuff and just be done with it!!

well up to what level it can be possible? if you sell some your personal stuff and it turns phaik, who will bother to pursue you really?
and imagine that buyer goes to the headquarters of some brandname with some used pants and what? will they sue you for 10-100 bucks?? of course if you are not a chain seller of that stuff...
even if it happens, how would they prove that this is the item you sent and not the one that the buyer is trying to falcificate?

I don't have much experience with this but if he lost the dispute then just sit tight and see what happens. That's what I would most likely do.

agreed most likely nothing happens, but some companies are really aggressive and thats usually in the US, we dont know what or how much OP sold...

If you used a stealth account 99% chance nothing will happened. If you used a real account and only one time this happened 1% they will do something about it. They will just keep an eye if you keep selling more and then send you a letter from a lawyer asking you to tell them who you bought from and to pay them some fees for there legal cost of sending you letters and stuff and to give up any product you have and send it to them. Best thing to do is ignore and stop selling it. What to do if you got more product left? Go to another website who doesn't give a crap and tell that its imitation and let somebody else deal with it or throw it away if your wanna sleep like a baby at night.


The buyer is pissed because he lost the case and he wants his money. So now he using other tactics to scare you even though it won't work because your not selling hundreds of the same product unelss you are then you are going to get a nice visit from uncle sam!

If someone is a douche its not worth bringing heat on you. Would you take a 100$ hit if it meant you could possibly continue yo make thousands? I hope you would. Pissy buyers are to be avoided refund and move on especially if they wont return it

Just know that business always will have returns wherever its foo foos or real legit items and buyers don't want to take a hit with nothing. Big companies like walmart and target in the us get thousands of items returned weekly every week and they know better than us business is business.

Sadly, sellers MUST know their items - as GB stated, ignorance is not an excuse.

He filed what kind of case? I am surprised that he lost but consider yourself lucky in that regard.
