Default issue with a buyer

Hi, a few weeks ago, i sent out a £200 phone (i regularly sell phones and have no problems).

All was well and was sent tracked next day delivery (was also signed for).

Now, after a few weeks, the buyer is claiming they did not receive the phone and opened up a case (closed as i provided tracking).

Now they are saying they will get a claim back via the bank/paypal.

Is that even possible? Its an obvious scam but i want to know where i stand if they pull this off.

You first have to assume that your buyer is telling the truth. Isn't there a possibility that the local postie delivered it somewhere else?

It would be best for you to work with the buyer and local delivery office (if you used RM) before you make up your mind.

On the other hand, if it's a scam and they claim to PayPal that the item is different than what you advertised then you're likely to be out of pocket if they return an empty box. Let's hope they eventually find their item.

It's a 99% a buyer scam.
If you have tracking info and delivered to the right address and it shows that the package is claimed -- there's no way he didn't get it.
Unless the post worker stole it - which is unlikely.

Just tell him to complain to the post office.

Cellphone is a "highly" scammed item in general - seems like a scam sadly

It might be a scam but also there is possibility what neighbour sing for him and keeping this phone. This happened to me few times. Ask him if he living in the flat?

There are also is small possibility what this is not scam. If you will call to royal mail now to make the complaint they will tell you what they are behind for 3 weeks

He will lose INR case with Paypal since it is delivered and signed for.
If he files a chargeback with his cc issuer,Paypal will forward your tracking and signature to his cc issuer,it is up to his cc issuer to decide the outcome.
If you lose,you will also pay for chargeback fee,in US it is $20.

I might just take the loss if it gets to that. I know its a scam as they keep demanding to talk over text message instead of ebay messages. They also kept getting their story mixed up.

Hopefully they open up a INR case as that would definitely close and save my money.

But cant they open a 'not as described' case if the tracking case is closed?

Paypal will protect you with tracking showing delivered. The bank dispute might go on for a long time but typically the bank is happy with delivery confirmation as well.
