Angry Ebay Buyer Protection Case!

Long story...

I bought over $2000 worth of items from a seller in the USA.

I received everything except one auction which was $200.
Eventually the seller noticed his mistake and sent me a refund which was by echeque.
First the Echeque said it would take about a week to clear, however when the day came i got a message saying there was a problem with the sellers bank account and that paypal would re-attempt to take the funds 3 days later.
The echeque displayed a clearing date of 2 weeks in my paypal account.
Eventually the 2 weeks passed and the same failure message happened again.

I emailed the seller at least 7 times, which he NEVER responded to about my missing items and the echeque failing.
Eventually i opened a case on ebay and straight away he replies saying i have the items and then posts the delivery tracking number for the other items i received.
After a lot of back and forth from this seller via the case he agree's to refund me because he is in the wrong about the item, and then sends me yet ANOTHER echeque.
The echeque fails YET AGAIN and so i escalate it to customer support,
and ebay decides in the sellers favor!!!!

This is out of order, and i dont see how the seller can just get away with not sending my item and keeping the money as well.
What am i supposed to do about this? Just write it off and let him get away with it?

I know how you feel... With cases its like they do not even look at anything. It usually requires a call and talk to someone in person in this type of situation.
