While eBay (or any other such site) has to respond to takedown notices under the Digital Millennium Copyright Act (DMCA) they CAN take it further, if they want to. And eBay wants to. They don't want to be known as the place to get counterfeits. They want to be like their idol, Amazon.
So, even if what you are selling is PERFECTLY LEGAL in your country, that does NOT mean that eBay has to allow you to sell it (gray market). You have to remember that eBay is a private company. They can refuse to allow you to sell on their site for any reason they like - as long as they don't run afoul of the anti-discrimination laws.
I just point this out as many people mistakenly think that eBay MUST allow you to sell on their site unless they can PROVE you are selling counterfeits or scamming people. But that is absolutely NOT the case. eBay does not have to prove anything at all. Innocent until proven guilty only applies to your dealings with the legal system, NOT to your dealings with private companies. |
