Default Sending buyer demand letter

Anyone ever sent a buyer a demand letter to return an item they received?

Here is the situation. I only sell 3 items, 2 cost 199 each the other 20 bucks. By some mistake on my part I sent the buyer the wrong item ( 200 in place of 20 ). Now I wouldn't have know about this if the buyer didnt decide to leave negative feedback stating he received the other item but looked at the price and decided to keep it.

Knowing that I only sell 3 items I know exactly what item he received and would like it back of course. I tried emailing but thats going nowhere.

Other than the letter what other options do I have?

The only option I can see here is a lawsuit, which would hardly be worth filing.

I mean, the buyer didn't scam you or anything. Sure, they should have sent it back, but I don't see where they broke any laws...

All you have to do is contact your local DA office and let them know what happened. They will contact the DA there and try to work it out.

I dont see why it cant work the other way.

I have used this to MY advantage since that posting and got good results.

They will work with you like an attorney on your behalf when something to do with online fraud is involved. In this case, they didn't set out to screw you but didn't stop it either when they were in control and could help.

It alone can hurt their case. They could have mitigated the problem and didn't for their own gain. Kind of like taking advantage of a kid or elderly person when they do not know any better or of the situation.

Okay, that did come from the Wife. Her words are all grown ups words. Mostly. ha. ha

Anyway, Try contacting them.

I get what your saying... Like I said I wouldnt have known if the idiotic buyer didnt decide to leave negative feedback. So im going after him to regain whats rightfully mine.

Dont let up. If for some reason your local one doesnt sound interested in helping. Call the local one in the buyers area.

Im assuming you have record of him saying he got the item you will be claiming he has though right?? that is pretty important

I'd say your gonna burn alot of calories to recover 180 bucks. I'd just chalk it up to a very valuable lesson learned. Always double check the merchandise before you send it out. Amazon wont help you, the DA, and local authorities will not put a ton of effort into recovering the merchandise that you willfully sent out. They have bigger fish to fry. All you can probably do is negotiate with the a-hole and possibly split the difference. He holds all the cards. The thing I'm perplexed about is the neg feedback. If I received a $200 item for 20 bucks, I would of left a glowing feedback.I'm really sorry this happened, but outside of going to the guys house and confronting him, your pretty much out of luck. Move on I say.

You can always call his mom, moms have the power to do amazing things.

Joking aside, yea its going to cost you lost of time. When I started selling on EB I more then once did that, lucky all the things got returned and no negative feedback. People are such a holes at times.

I bet the buyer will end up denying it. I'd copy any remarks he/she said about receiving the item.

To bad they left bad feedback, seems like they got a great deal.

Lots of time is what I have. Online is how I make a living so 90% of my day is online.

You wont have to spend tons of time. Call the DA's office , the assistants do the work. In the fraud division, that is what they do is handle claims like this. Just call them and talk to them. They hassled me with letters and all that crap for less than $20 so i know they will do the work.

This happened to me with a $600 tv and $20 DvD years back.

The attorney I spoke with told me not to peruse it. She didn't commit a crime and it was my mix up and she could just deny it.

I called her county sheriff office and explained the situation and they wouldn't do anything either.

Talk about eating it.

Im sure you could file a lawsuit but I hardly doubt it would be worth your time.

A lawyer wont pursue it. That isnt what I said to do. Contact the internet fraud division in your local DA's office. If you dont want to then yes eat it.

Im not making that crap up. Its what they are there for.

The things they dont pursue is those BS Craigslist scams. They simply say they are too complicated for them. becuase they are.

Just call them and get it over with already. lol

My mom knows a lawyer, had him write me up a letter, sent it to buyer. Next thing I know buyer is communicating with me. :D

I hope it works out, and perhaps this person would scare easily. There are a lot of people that would just throw that letter in the trash and say bring it on. If the person is now communicating with you, suggest to that person that you will drop the whole matter by refunding the original 20 bucks, sending the original merchandise to them in exchange for them removing the neg, and returning the 200 dollar item. You will pay return postage too. May work. It was your error, so you have to resolve the issue. On a side note, just to salvage the feedback, I would send a small gift as a token of your appreciation for their cooperation, and inconvenience. Small price to pay to keep a solid account in good standing.

Next time be more careful with your orders.

You lost this one.

If you go to court you do not have ground evidence to prove you did ship the wrong item to him, not even using the other buyers testimony.

HE has the item in his hands at his home, is his property.

Curious to hear if youyr buyer complied witn your more than reasonable compromise or is he still being a a-hole about the issue?

I have been in your shoes but have been lucky the buyer was easy to work with about getting the item back to me.
