Had a scamming seller, their feedback tanked and no communication with them. We know how all of this goes. I opened a Not As Described case, they replied before going underground. I escalated to ebay and got the "we will respond within 72 hours" deal. Well that was 5 days ago. Usually these things take one or two days MAX. Check the resolution center and it still shows "contacted customer support, waiting for response". What gives - my case went down the rabbit hole?
The complete step-by-step guide to get back to selling today!
Never ever escalate the case online. Always call & ask them to transfer you to the eBay buyer protection department. Explain your story etc. In most cases they usually pick the buyers side.

No, why would you call ebay, I wouldn't do that, they might ask you questions that you could give them a wrong answer to if it were a stealth account, just deal with it online, always provide tracking information.

Could be that you - the buyer - have been reported using the new "report buyer" function that is now allover ebay and this could possibly delay the case.
