I know of a few traders that have had vero owners take them to court. Here in the UK Adidas, Nike, the Arcardia group (Top Shop, Burton etc) are prolific for it.

I recently read that Louis Vuitton / Gucci are slack as they believe that the counterfeit industry actual aids their sales through authorised stockists. Stone Island have been known to force UK traders to stop selling goods here that are licensed only for sale in Italy
The complete step-by-step guide to get back to selling today!

Hey do you have the Nike Airforce one with burberry print?

I guess you didn't know that Nike are VERO owners too.

They are stinkers for pulling listings in the UK. Like Adidas they actually do go to court over trademark infringements.

I know of a few traders who have been stung badly too. Nike are strict on products or designs that are not market specifically for the UK. Anything that is considered a 'parallel market' product even if legit and authentic will certainly be pulled, receipts or no receipts.

Trademark law read a book it may just help you keep your trading life easy.

Default VERO? Does anyone know how to be Vero.

Just wondering, what do these "experts" do to become a verified rights owner? Can anybody do it? If anyone has any idea I would appreciate a response. Thanks.

You're a VERO if you own the rights to the mark.

They see someone selling their stuff, they file a NOCI form with all the correct information. Then eBay removes the item, and probably the seller.

You become a VeRO once you see someone violating your rights on eBay, not before.

I THINK there has to be some way to PROVE you have an interest/rights to become Vero--I hope so anyway or everyone would be Vero. I assume there has to be hard-core proof you can substantiate your entitlement.

Also, don't you have to go though some sort of verfication process to "prove" your personal details--that wouldn't be good if you operate--"Stealth"???

HI- Besides the initial verification process, they send a welcome letter. Then, the first couple vero Violations are via fax, then after they feel comfortable--then u get the built in tools on your web server to report vero just via the listing--i.e. shut it down almost instantly...

jscan, if you are making an objection under 'vero', you probably are the actual company!
You have the title/proof with letterheads, attorneys etc. Never heard of anyone fudging
vero.

So many people worry about being sued by vero memebers. VERO is a load of crap, as aspkin said unless you have a factory in your backyard producing thousands of units per day, or selling thousands of units theres really nothing they can do.

all they do is try and scare you into not selling there items anymore. pointblankperiodddd

HI Folks: Have a Close Friend who owns a Vero Brand, I do not sell. Heres some info she forwarded to me...(from the Vero team);

Welcome to the eBay Verified Rights Owner (VeRO) Program. We have forwarded the listings you reported for appropriate action. You will receive a separate confirmation email regarding the specific action taken. ***Note*** If you submitted a Notice of Claimed Infringement for multiple sellers, you may receive a separate response about the action taken for each seller's listings. As removal requests are processed separately, you may receive these notices at different times over the next several hours. If you have reported listings on sites other than the US, a copy of your notice will be forwarded to the appropriate international personnel. You will then receive a response from them shortly. When we remove a listing, we will send an email to the seller and the potential buyers explaining that the listing was removed at your request. Many sellers may not know why their item or description infringes your intellectual property rights. Hence, we will send the seller the name of your organization and your email address and encourage the seller to contact you directly for further information. This email includes important information about: - Reporting an infringing listing - Requesting personal contact information - Creating a VeRO About Me page Report an Infringing Listing As a VeRO participant, you have multiple options for reporting a listing electronically (details about each method are included below): - Use the VeRO reporting tool - Email a Notice of Claimed Infringement Use the VeRO Reporting Tool We recommend the reporting tool because it's the fastest and easiest way to report infringing items. It allows you to file a report directly from the listing page. It also helps reduce the number of infringing items listed on eBay by educating sellers on how items may be infringing and what they can do to ensure that their items don't infringe intellectual property rights. When you file a report using the VeRO Reporting Tool, we are able to: - Give the seller detailed information about the VeRO violation - Direct the seller to our intellectual property tutorial - Direct the seller to the appropriate Help pages based on the reason you select on the form - Direct the seller to your About Me page To sign up for the VeRO Reporting Tool, just send an email to vero@ebay.com Email a Notice of Claimed Infringement To send a report, email a completed copy of the electronic Notice of Claimed Infringement form (details below) to vero@ebay.com. For your convenience, we've pasted the notice at the end of this email. ***Important*** - Be sure to paste the electronic Notice of Claimed Infringement in the body of your email. For security reasons, we cannot open attachments. - In the subject line, enter "Electronic Notice of Claimed Infringement." Request Personal Contact Information To request detailed contact information of a seller, please send an email to vero@ebay.com. We will send you a copy of the appropriate Personal Information Agreement. ***Note*** eBay is unable to ensure the completeness or accuracy of any personal information provided. Create an eBay About Me Page We have found that an About Me page can answer many questions that sellers have and lead to successful listings. Your About Me page enables you to: - Provide contact information - Provide the eBay Community with specific information about your products and intellectual property rights - Answer frequently asked questions - Give links to other sites with important information When we remove a listing at your request, we'll provide the seller with a link to your About Me page. This will help the seller understand why the listing has been removed.

Thank you for contacting the VeRO Program. We can certainly understand your concern regarding the listing in question. Unfortunately, we are unable to remove this listing based on your email alone. Through the Verified Rights Owner (VeRO) Program, you have the ability to request the removal of listings you believe infringe your copyright, trademark or other intellectual property rights. However, so that we may take appropriate action, you must submit your requests in a completed Notice of Claimed Infringement. Be sure to identify the specific listings that are infringing on your intellectual property rights by number; the user's screen name or user I.D. is not sufficient. For your convenience, I have included an electronic version of our Notice of Claimed Infringement form below. To reduce our response time, you may submit future Notices of Claimed Infringement electronically to vero@ebay.com. If you should have any other questions or concerns regarding this matter, please do not hesitate to contact us again. Sincerely, Chaunnah eBay Customer Support ______________________________ ***** Electronic Notice of Claimed Infringement (Original Signature on File)

i just got one of these letters for selling a logo that looks similiar to jack daniels, but doesnt say jack daniels on it, nor did i use jack daniels anywhere in my sales description.
the letter says they own the rights to "no. 7" and to send them a money order of $4700 to avoid further action.
I looked up the info where the letter came from (certified) and its people resprensting JD and other logo's. kinda like CAPS for NFL.
i replied to there letter and said I didnt intentially infringe on their mark, i dont even use there name ANYWHERE, with that said i will do the appropriate thing by removing the sale in question.
cant believe they want $4700 for damages. they even bought one of my items and included a picture of it for proof of merchandise. or perhaps a person turned me and sent them the picture to provide. either way i dont have $4700..
all this for something that doesnt even bare their name... crazy huh!?

Default Ebay Account Suspended For 7 Days! ! ! Trademark Violation??

HELLO EVERYONE.. COMING BACK TO THIS THREAD AFTER DOING BUSINESS ON EBAY FOR ABOUT 6 MONTH'S WITH MY NEW ACCOUNT WHICH IS SUSPENDED. AGAIN! but this time for only 7 days.. now, it is really my fault i believe, i became too relax in the six month period and started selling crazy... recently bought some items here locally but turned out to be ⊗⊗⊗⊗, and the only way i found out was when ebay pulled them... so now my account is suspended for a minimum of "7 days" now i dont know what the procedure is on getting back, but I heard I have to submit my information which of course will not match the one on my ebay account.. The only positive thing I have out of this suspension, is that I had unpaid item fees of $400 :-) U know how I do... is there any chance I would be able to get back on ebay without submitting my personal info to them??? of course I would never do that but just want to know if anyone had any luck getting back on ebay..

Now if there is no way for me to get back on ebay, is there anyone here that is willing to sell me their 30 day account for some $$?? im really eager to get back on and start selling..

Also one really important thing, I noticed that NetZero does not provide that internet phone service so that we can input into ebay.. Is there any other service which I can sign up to get a valid phone number on the internet so that in case ebay decides to call it, it would at least be valid.. i really appreciate this forum.. Been doing good on ebay in the last six month's and got about 50 feedback's whith prices ranging from $200-900 on each feedback...

I would really appreciate any suggestions on how I can get back on ebay and start selling right away.. thank you
