Fortunately the buyer was stupid enough to not only sell the same item from the same account he bought it from, but also used all your pictures too.

If he was smart he would have used a different account completely and taken new pictures. Geez.... it's bad enough to get scammed, but to get scammed by an idiot makes it more frustrating!

Ever had your listing stolen and pasted on a website word for word, pic for pic? Happened to me. Dude bought one of my watch tv on pc programs and I saw that he had a website in his paypal payment details. I clicked on it and BAM there was my listing but on a WEBSITE. So not only did he start a website selling MY Programs, he even used my listing! I don't know how to describe the feeling one gets when you see it. I worked on that listing for 5 hours I remember, and someone just copy and pastes it.

As soon as I saw it, I emailed him threatening to report him to ebay, paypal, and copyright authorities. The next day, it was taken off fast. But still, it gave me a bad feeling in my stomach to know that someone will actually do that.

Most people will try to copy you if you are successful. In this case, it was obvious I was sell them like hotcakes. Had 5 people resale my programs without permission in ebay, That I caught. I reported them and ebay pulled their listings but they would spring back up by changing the description. I couldn't do anything to stop them so I just updated them frequently and offered 7 day full refund.

Those resale rights are for 1 cent ebooks. Mine were software programs.

I am still selling it but not on ebay. ebay banned all digital items except in classified ad format, which are very weak in sales. Or you have to make a real CD and ship it, which is too time consuming for me. Sales at the other place is picking up. I sold 4 yesterday, a record. But in ebay I can sell 25 in 1 day. I'm thinking about making a website but my website making skills are noobish at best.

Come to think of it, there is one dude who is still selling MY programs in ebay. I'm about to make 5 accounts and neg him. muuuhahahaa

i thought the neg would not be removed as long as the buyer simply responds to non-paying bidder dispute.

Morning all, just stumbled across this site and BANG! First topic I read is close to home.

Here is a little two cents from someone on both sides of the fence.

IMJUSTME, you could have reported the guy to eBay about the listing violation, showing that he used your pictures and such. Keep a copy of the auction (just screen grab it). Now since he took delivery and claimed that he did not get it, then listed it, you can get him for mail fraud. You contact him and advise him of such and he would back off for it is controlled by a government agency.

With eBay and negs, you can purchase but have to wait to give a neg. If an unpaid buyer report is filed you just have to respond to it from what I have read in order for the neg to stand, but the response can not be "I'm not paying".

Other then that the go in and neg is funny.

If your listing information is used by someone on their website I would contact the Server Company and list the violation to them giving 3 days for it to be removed. They will take the page down and contact the owner advising of the copyright violation, that is if you have proof of such. I have a number of sites and I found someone copying my sites in their auctions and had eBay remove them. I have an open contact with eBay if someone uses my copy for their auction and they take it down in one hour.

ebay wont look into screen shots, there bad enough when you report someone using your pictures/listing details, they usually take 72 hours to respond and initiate and by that time the listing may have finished.

To get a neg to stand for a dispute either the seller has to close it so it doesn't give you a strike, or you reply and say that there were transaction problems and poor seller performance. In this case, his wife/husband (depending on if he made the account a male or female identity) or friend needs to have told him he paid too much and so he googled around and found the same item selling for less from another seller and he found out that he just bought from a seller who copied from another and ripped them off.

imjustme is in Japan. The other party was in the USA. And it sounds like imjustme didn't bother to get any kind of signature confirmation. From my experience USA's law enforcement doesn't care about ripping people off unless it's for high amounts like a million dollars plus. The FBI even has a rule last I heard that they only investigate crimes if it's over $10,000.

If you want to see proof, just go in google news. You'll see the news articles showing what USA's law enforcement investigate.

They spend 99% of their manpower and money on busting people for CP and child luring (and of course they don't care when an adult gets stalked).
The remaining 1% is for when someone rips someone off for millions. Or else like Vladuz hacked into some company that makes billions of dollars regularly like eBay and they tracked him down to Romania where law enforcement normally wouldn't care about that at all.

Now maybe law enforcement would do that in Japan, but not in the USA. I also heard that Japan recently made CP illegal (which was a shock that it was legal there) and so their computer crime law enforcement probably had been focusing more on people who rip you off on eBay. But back to the USA, the law enforcement generally doesn't care about cyberstalking of adults (of kids it's a different matter but adults they don't care) and they also don't care about some petty online thievery. Law enforcement claims it's a civil matter and you have to sue. imjustme living in a different country would have a hard time suing someone over an item that wasn't expensive enough to buy tracking for.

Default buyer running around eBay ruining everyone's feedback score...

I had a buyer win an auction about 2 weeks ago. I shipped immediately and today he left me feedback ....neutral feedback saying everything great, no complaints. So I ask him, why leave neutral if everything is "great"? He responds back saying I never leave positive because I think there's always room for improvement for every seller. Indeed, I check his feedback and he has over 30 neutral he has left over the past 4 months. Unbelievable, isn't it? With the new feedback score in effect, a neutral counts like a negative for sellers, so he's actually running around ruining the score of every seller he buys from.

I just got a neg from a buyer who gave me the wrong shipping address, it came back to me, I told her to send me the shipping again via pp and she refused saying the shipping has already been paid.

She sent me the wrong address and it was undeliverable. I checked her feedback and she has some real issues before the feedback changed and now she is going back to those who negged her before and leaving them negs on purpose.

Ebay wake the heck up, if this is not abuse of the system then what is?

So, since she left me a neg she will not get her item until she pays me the shipping back to her. I was going to eat the cost but not now.

LOL, this sounds like a hilarious buyer. I laughed so hard when I read your post imjustme. Damn, what are we going to do with all these crazy buyers running around...?

because the new ebay feedback system, that as a seller can't leave negative feedback to buyer,
now, for a bad buyer leaving neutral feedback or negative feedback without any proper reason,
I will unmark the payment received, then open an unpaid item dispute, and then close it as soon as it can be, that will give a dispute to his ebay account, hopefully, more seller also got a bad experience with this buyer, and also give him an unpaid item dispute, as some point, his ebay account will be suspended...

that is what I could do when dealing with the bad buyer...
