So has anyone had any success with court or a demand letter? I was new to PayPal and had only taken 4 transactions, 3 from my kids/wife and then 1 from a Kobe jersey I sold on eBay for $5700
Immediately after that eBay transaction they shut it down because that transaction was not normal for my account, even though it was eBay and they saw the item was delivered and feedback left they still kept it shut down.
Fast forward to the $ being released on 7/6 and I didn't see it til 8/8 and I log in to retrieve it only to see that the money was taken on 8/6
I have no idea what to do now

So, after starting this thread, I haven't read all of it, but I assume folks didn't get their money. But I'm curious if they have continued confiscating funds on your other stealth accounts, or did they just do this in a wave and quit? I ask because I had other accounts get limited after this, and 180 days later I was able to get the funds.......

Confusing question. What r u on about. Pp ALWAYS was comfy to keep your hard earned £££/$$$ in their pockets - give no reason - no Policy applies - RULES. I used to deal with some criminals - Trust me. PP are WORSE...much worse. oops. im v****ed..now..ip..help..Maybe shell i say Sorry. Im not intend to...blah/blah..

Paypal has cited "Acceptable Use Policy" to wipe out my account balances on December 11, 2019 and March 11, 2020 and May 8, 2020 and August 4, 2020 and August 28, 2020 so they are still doing it.

I have sent a demand letter to Paypal 5 times now throughout 2020. They have ignored them all. A large law firm told me the following:

(1) we do not write demand letters on contingency; (2) $400,000 is below our threshold for an individual lawsuit (should the demand letter fail you will need to litigate this case – which it will. Paypal does not simply roll over with a demand letter; they fight everything); (3) Paypal’s terms and conditions mandate arbitration which is a much less favorable forum for plaintiffs than court; and (4) Paypal’s terms and conditions now contain a class action waiver which means no one can bring class actions against Paypal anymore which were the only truly viable cases (financially and legally).

It is likely I need to do arbitration through ADR.org since apparently Paypal's TOS means they make the rules, even if they are unfair & illegal, cannot sue can only do arbitration.

the policy is published on its site,it has nothing to with linking to another account ,BUT then,may be your brother is doing something which violates the policy??
Listen, the Acceptable Use Policy is a complete joke, & while it starts by saying common sense illegal things, it then devolves into the following vague ambiguous nonsense that could be applied to anyone " 3(d) are for the sale of certain items before the seller has control or possession of the item " which is extremely vague because which certain items?

I assume this to mean "drop shipping", but drop shipping is what many sellers on eBay have done for years with their paypal account so who knows what it really means, it can mean anything Paypal wants it to mean to steal anyone's balance at any point.

PP made a payment to PayPal effectively wiping my balance 12K USD.
with memo "PayPal's damages caused by AUP violation".

Please do not ever stack up PayPal balance.
Always transfer to your actual bank immediately.

They define in their User Agreement they will take action "in our sole discretion".
They vaguely define various violations.

According to their user agreement, they can do literally anything they want to do your account at any time, any actions, not even revealing what was the exact "violation".

Have fun searching "sole discretion" in this document:

I can confirm it happened for Asia accounts. It applies worldwide.

I am still not sure what causes this.

1. Permanent limitation will always show "inconsistent with AUP" on the PayPal.com website
2. Permanent limitation will always show "there was potential risk" in the PayPal.com website notifications

I think you need to paste what the email exactly told you at time of limitation.

I had $90,000 taken from me. They claim I violated the AUP which I disagree with. But either way I don't know how they can legally fine us $2,500 per offense. Could they say $50,000 per offense. This doesn't seem legal.

seems like paypal are doing way to becoming amzn. Take your money and if you wish to claim your money back you need to file an appeal or hire an attorney

I'm new here but a victim as well. Not as much as some of you, but $5600 that I was told would be available after 6 months - to ensure no disputed transactions - then they just took it.

Has anyone had any success in retrieving their funds? How are they protected against a Class Action Suit? From everything I'm reading, it sounds like there would be a huge one justified.

180 days limitation regular vs AUP are 2 different things.

You seem to have gotten the regular one, so wait it out and withdraw.

For all who wonder about getting the money paypal stole. Read my previous threads
1) send them a letter of intent, stating you will sue them in small claims court, explain your reasons, make a strong case, that what they are doing is illegal. which it is.
2) wait, usually after 30 days they will send you an email stating your acct has been reinstated. then they will send you another email that your balance was reinstated.
3) withdraw balance. NEVER KEEP MORE IN PAYPAL THAN YOU ARE WILLING TO LOOSE!!!
