We have all had our share of this but I hope the OP does not give up because there are two things I wont give up on.
Beating eb/pp and allowing a buyer to defeat me when I know I am right and they are trying to destroy my account.
I am in until the end...seems Alex H. is dead set on not approving my appeal despite all of the facts involved. If so, then....well, let's say ebay will foot the bill in ways they won't like.

Well I received email stating case has been closed, decided in buyers favor and buyer was issued a full refund. Went to resolution center, it shows "appeal case". So I clicked that, wrote out the situation and flat out said I will pursue this to my fullest extent of law if they continue to side with the fraudulent buyer, and they have disregarded all of the facts i have presented including the police report. I will be writing some emails to higher-ups if this keeps up.
So any positive updates on what happened when you appealed the case?

Of course you can always refuse a package. But then what happens? Tracking will show it returned to buyer. Then what? 1)Buyer might give up so you will win the case when it expires 2) ebay tells buyer to resend it - if refused again - probably you will lose. But at least buyer will get hit up for more postage.
You would have to be EXTREMELY confident that it is a scam to refuse the package because it will cause a legit buyer to leave you horrible feedback. It might be a tool to employ as in a case like this - but it would be very rare.
Secondly, you always have to weigh the costs of getting a lawyer involved. A demand letter can cost $100-$300 so it would have to be an expensive item to be worth your time and retaining a lawyer.
