at least in the US, it will say attempted delivery, then notice left. i believe after 5-15 days(depending on the service) it gets returned to the sender. at that point it'll say 'return to sender' and will update from there.

Thanks for the feedback much appreciated. It's a sticky situation. Lawyers are so expensive in America! Would you know of any lawyer/friends/associates who could help pull a letter out for you? How about taking them to small claims court there? I've seen it happen on "Judge Judy" show here in Australia? Is that worth it? I mean $1,600 is A LOT of money in my pocket.

Anyone could file but the USA have different regulations for each state. Costs might add up. OP may be in one state and this buyer is in another one. Gets tricky

This happened to me for similar funds and I filed a complaint with the buyers LOCAL sheriffs office.

They told me they usually do not handle ebay issues.

I did not allow them to pull this bs.

I told them it was well over 1000 which is no longer a minor misdemeanor in your state and it is your job to investigate because the buyer is giving me a house that is currently empty.

They tracked them down, lived in a trailer on a back lot of the property and not the house and I got my money.

Sheriff scared the crap out of this buyer and it did not take long my money showed up with a million apologies too boot.

Well I received email stating case has been closed, decided in buyers favor and buyer was issued a full refund. Went to resolution center, it shows "appeal case". So I clicked that, wrote out the situation and flat out said I will pursue this to my fullest extent of law if they continue to side with the fraudulent buyer, and they have disregarded all of the facts i have presented including the police report. I will be writing some emails to higher-ups if this keeps up.

I guess this must be what VERO buyers feel like after they've been duped.

do yourself a favor and be quiet right now.

This is nothing like a buyer of foo-foos being duped.

This compares with your own paypal issues. I do not recall any of us offering platitudes to you.

The OP's integrity as a seller is under cloud.
He is out of pocket hundreds of dollars.

A supposed system has failed him.

Please avoid spruiking just for because you can. In another thread, I suggested you go learn about ebay. Please do that. Please discover how sellers get fried.

GB, I do feel for this seller. I personally would probably hop on a plane and pay that buyer a visit. Not kidding.

But I do think fraud is fraud.

This buyer defrauded the seller, and sellers who sell items that are classified as being real but are knockoffs are in the same category.

A lie is a lie. It's like saying someones a little pregnant.

I agree this Seller got royally screwed over. I'm sure he's out more than a couple of hundred also.

Roscoe, you of all people should know - the line between clever marketing and lies and fraud is razor thin. 100% all beef patties and pink slime come to mind.

What happened to the OP has nothing to do with the principle of Buyer Beware. Please let's drop it.

I really wish this had a better outcome. What happened here only illustrates that selling on eBay is like walking into a casino and heading over to the craps table. Every transaction is a roll of the dice.

I can't imagine how anyone could sit there in San Jose, look at the facts and decide that this buyer was totally on the level. I have to believe either they throw darts to decide these cases or just plain don't give a ****. Either way all the talk about seller protection is nothing but horse****.

Actually it was somewhere in Utah that this "Alex H." is at. At least that is the phone number that he had called from one time which I unfortunately didnt answer. The fax number I was given was a colorado number. So I dont know which of the two he is at...its a mountain time zone state, I know that much for sure from the hours of operation that segment works and more specifically him.

I sent an email to several high-up execs and such...I doubt I will get a response or even a once over. From that point I guess I will have to figure out how far to take things and where the line should be drawn

This goes out to the OP, sorry to hear that. I had lost a case once for an amount. I recalled and told ebay straight up. That I wouldn't scam the buyer, due to selling 1000's of these products already and I would not risk my account for a item.

Did you sell a lot of these before on the account? IF so try to get a hold of someone in paypal if you tried with ebay and failed. I've always had better luck in Paypal then ebay with any case really. They seem to speak American English and be Americans on the phone.

This is very scary, and the people that get away with this.

I wish ebay had a safer way of doing business for sellers.

This totally blows! But don't lose all hope or motivation.

Is there anything you can do in the future to product from this happening like insurance on the package maybe? Also I don't know if you showed them the picture of the package with the price value of $35 when the item was worth $1600.

I wonder how other people who have been there handle something like this. Sorry to hear bro! :( Sucks!

Whatever happens, please don't give up (unless of course you feel it is not worth it). I say this because if all sellers pursued fraudulent buyers will full force (where possible) it will put them off doing it again and again and again...ripping off sellers. I personally had someone do the same thing with me can you believe it with something inexpensive! I had 4 years of 100% feedback (no negative feedback at all) and of course I looked at her feedback and contacted some sellers and same story - she'd put claims all the time and won - so she kept on doing it again as she knew she could get away with it. Stupidly she also sold on the same account - of course you all know what I did then. Karma is a bitch.

Yeah don't give up man!

Get to the bottom of this and research some more on google and I am sure you will run into people who had the same story as you and see what they did to show proof that worked to win a case. It could work in the favor for you also.

Even some of my products on ebay have a 30 day return policy on unopened items, yet if a customer uses it or take its all and reships me an empty ebay/pp still believe the seller is at fault. I hate that about them at times. Even if it's been over 30 days, they still do that. So why have a policy in the first place if they won't hold their part of the deal? I believe ebay should be looked at by someone in the BBB for such things.



I've read so many horror stories that, all you can do at this point is live, learn, let go and move on. But keep searching google to see how others have handled it and research for sure. There are ways of doing this to win each time!

Just think how do buyers with 1 Million + or 100,000+ feedback do it if they send a laptop and someone pulls that stunt. They have to have a way also of winning. If you are a power seller for that amount. Don't you have a phone number to call and talk to a rep about it? Keep fighting it! Don't ever give up man!

This gets to me how they do this one after another and ebay does nothing about it! And yet sells it back on the same account!

This is why I like to fight these types of scammers to put my foot down so they don't keep on doing it over and over again! So it can prevent them from doing it to someone else. Every tiny problem I have, I call up ebay/pp ASAP right away! I've had a guy open up a case on me 3 days after paying for an item saying he didn't get it. I told ebay look his got a new account. My product is in the USA and his in Australia no way it will get there within 3 days this guy has a new account and is scamming me. I won! And I let them know that I wouldn't scam anyone for a $30 item when I have sold 1000's of these under that account. Yet the guy had the guts to call me a scammer in the open case with PP, saying he never got it. The people on the phone at the time Paypal read it and laughed over the phone and told me not to worry about it. I never heard from him again. And he tried to write in the case that ebay/pp are letting me get away with this and this is a horrible buyer experience, and that he will never buy again from ebay blah blah blah. I guess it really depends who you get on the phone, and the way you talk.

I've read a story on here when a seller sold on many stealths the same type of item and some guy bough from all accounts and pulled an open case on all his accounts and yet the guy resold it from Eastern Europe on some website on top of it with the same PP account!

I am Gold Power Seller and TRS. It doesnt matter...ebay doesnt care. Even though I have 100% feedback and repeat customers...5 star DSR in all categories. I just dont get it...blatant disregard for any and all info that was submitted. Now because this case I will lose TRS status....and its in the bs category, 3 cases open. Not 3 cases without seller resolution! I see TRS with 10s or 100s of negative feedback...and you KNOW at least 3 or more of those buyers opened cases. Yet they still have their TRS status. Now tell me how thats possible when its 3 strikes youre out??? I dont know...I hate ebays policies. And its not only about losing the money and product, its also my status being stripped after working hard to achieve it. One piece of **** buyer and it all goes down the drain....when it could have been avoided by this dipstick of a rep reading the facts presented.

Maybe the 3 strikes you are out is because you have low feedback. If you got 500 feedback and 8 open cases (in 12 months) it does hurt the account. But if you have 5,000 feedback in 3 months and only 8 open cases, it won't matter due to the avg. That could be why. IT's also the 99% or %99.9 that they have that brings their avg below .50% required. I've seen my TRS status come back when I gained 127 feedback in just 5 days.

How many feedback you got in 12 months? If you got more then 400 feedback in the last 90 days, they avg it out for the last 90 days only. If it's more then 400 feedback then they avg it out for the whole year. I've seen sellers with 117 negative feedback, 65 Nuetral, and 33,000+ positive for 30 days. It's avg of feedback in the last 90 days for them. Or maybe they are so high up there, and got their own private person in ebay with that 800 number. I don't know I never been there so I couldn't tell you. But I am sure it's due to your feedback.

I have some fabulous tricks up my sleeve for these complete wankers but they probably only work in Australia and not in the USA and I don't sell internationally because of this. Tried getting a job with eBay and PayPal and they are only based in one state in Australia that I don't live in. Please boost don't give up!!! I have tried to find that thread where a seller bypassed all eBay and PayPal BS and went straight with a letter to the buyer but can't find it!!! So sorry!!!

Oh I think I remember that one, but they sent the letter to the buyers parents. Mother found out what her son was up to and the situation got corrected pronto. I am pretty certain the buyer is a middle-age guy in this case - not a teenager so probably he has his mum tied up in the attic.
