I did the same as you and took a video the box being opened. I gave paypal the youtube links and they never looked at them once.case was closed in the buyer favour and the $400 was reimbursed to him.I then appealed the case with a police report and was refunded pretty quick.

is the signature, the name of the buyer?
the film, did you submit it as evidence?

maybe getting postal worker to witness the contents when delivered is good idea
I had chargeback for INR even though there was trackings and lost - twice, although paypal said they would fight them for me, but they stopped communicating with me other than asking for neg balance to be resolved. it was like they were not bothered to actually fight it actively...
I also got SNAD saying not working item, so sent another without getting item returned and she had the nerve to say that was SNAD too! and charged back....
being stealth..I always had to let the fight go
if it was real details, there would be no way I would let go, up to the end...
these were all expensive items....
it is why I do not leave too much in balance..
good luck...I want to hear a good outcome on this....update us...

Nah. The mailman hands you a big, goofy iPad like box, gives you a fat weird electronic pen, then holds it in the air for you and says, "sign here."
You can't even see what the heck you're signing.

Well here is hoping they do what is right!!
Cannot trust ebay with anything now days.
However they have to do something if you open a fraud case, else it could be seen that ebay is assisting the buyer in committing fraud.

I just received an email from "Alex H." again, stating fax the police report and he would be happy to grant my appeal to the case. He makes contradictory remarks throughout his message...we will see where this goes. I am not too optimistic regarding the situation, but we shall see.

Never heard of high risk dept. It could be BS. I would advise to get someone in T&S or a supervisor. Tell them you faxed it and this guy Alex cannot find the fax. Ask them how to rectify the situation - or put Alex on the phone.

Anything over $700 goes to a high claims buyer protection department.

Are you able to REFUSE a return package at all (i.e don't sign, refuse to accept the returned parcel?). I hope you fight it and win. A letter direct from a lawyer would that work at all (forget PayPal and eBay), I have read that somewhere on this forum a seller didn't bother and went directly this way and he almost always scared the fraudulent buyer and they all pay up. I will try to find that thread. Update us on the final outcome please. Makes me scared to sell high value goods because of this. I normally do pick up only - strictly no paypal accepted.

Then what? 1)Buyer might give up so you will win the case when it expires 2) ebay tells buyer to resend it - if refused again - probably you will lose. But at least buyer will get hit up for more postage.
You would have to be EXTREMELY confident that it is a scam to refuse the package because it will cause a legit buyer to leave you horrible feedback. It might be a tool to employ as in a case like this - but it would be very rare.
Secondly, you always have to weigh the costs of getting a lawyer involved. A demand letter can cost $100-$300 so it would have to be an expensive item to be worth your time and retaining a lawyer.
