Not Suspended Yet . . . . but,
Hi All,
I am (was) selling a legit product but it was in electronics. First, got an MC999, stating that "After reviewing your eBay account, it appears that you have violated eBay's Trademark Violation - Unauthorized Item policy.
Your listing was removed after the rights owner reported it as counterfeit. We urge you to contact the rights owner directly for more information about why they requested the removal of your listing and whether you can relist the item." They said they had taken down my listings.
So, I'm not suspended yet, but apparently Ebay left my listings up (unbeknownst to me) and they sent me an MC067 stating that if I listed the products again I would risk getting suspended.
I have been a seller since 2002 and I've been selling these particular items for at least 6 months now and I have feedback from several of my buyers that they actually took the item they bought from me to Best Buy, where they found that the item I sold them was indeed, authentic, and exactly the same as the ones being sold at Best Buy.
I also have a certificate from my wholesaler that says that their company has the rights to sell the items I buy from them, although it's a little hard to understand, since they are from China; however the note is notarized.
I emailed the company that said my items were unauthorized and I have not gotten a response from them. It's been 5 days. Ebay says to contact them if the authorized dealer does not reply.
I would like to call Ebay and state my case, because I think a competitor did this and not an authorized Rights Owner. My question is, do you think it will make my case worse or better if I call Ebay? Or is it even worth it?
I would appreciate any feedback you can give me.
If it doesn't work, I'm stuck with $2500 worth of merchandise that I cannot sell.
