Default Help me out as a buyer..

I've purchased 8 "new" items from an amazon seller.
The next day I see that same seller is selling the same item this time "opened box" for the same price. My flags went off.....

My order has not shipped yet so I email the seller to confirm the items are "new". I get a response that they can not guarantee the items are "new" as they buy closeouts in bulk blah blah blah and they ship my order. I did not like this as they should of asked me if this was ok to ship.......

I get the order, and all 8 of them are opened box with best buy price stickers on them :/

I email them back saying I got the order and they are infact opened items and I would like to return them and they tell me to "recheck" the seals to make sure they are broken.

I ask them to send a repaid return label since the items are not as described(he has neg feedbacks saying they sent the wrong item and had to pay the return shipping)

They send me a return label but tell me that the shipping costs are not refundable since "we told you we can not guarantee if the item is sealed".

This seller is not providing good CS esp since they are at fault and I guess they have a 84% feedback for a reason.

This guy is giving me the round around and not giving me a good feeling :/ Im not at fault and the item is not as described. I already told the guy I wont leave neg feedback or open a claim, I just want want is fair.


I have a bad feeling about this and I just want to make sure I do everything right in returning this. If anyone has any tips let me know.

Take the issue up with Amazon.
